City Council on December 4, 5 and 13, 2018, adopted the following: 1. Council adopt the confidential recommendations in Confidential Attachment 1 to the report (December 3, 2018) from the City Solicitor. 2. City Council authorize the public release of the confidential recommendations in Confidential Attachment 1 and Confidential Appendix A to the report (December 3, 2018) from the City Solicitor. 3. City Council direct that the balance of Confidential Attachment 1 to the report (December 3, 2018) remain confidential.

The confidential recommendations in Confidential Attachment 1 to the report (December 3, 2018) from the City Solicitor were adopted by City Council and are now public, as follows: 1. City Council direct the City Solicitor and appropriate City Staff to attend the Local Planning Appeal Tribunal hearing scheduled for January 31 and February 1, 2019 to oppose the inclusion of temporary permissions in the Zoning By-law amendments for two parking structures. 2. City Council direct the City Solicitor to settle the appeal of the Site Plan Application in accordance with the Local Planning Appeal Tribunal's find order on the Zoning By-law amendment. 3. City Council direct the City Solicitor to request that the Local Planning Appeal Tribunal's final Order on the Zoning By-law amendments be held until receipt of confirmation from the City Solicitor that: a. the final form and content of the Zoning By-laws are satisfactory to the City Solicitor in consultation with the Director of Community Planning, North York District; b. the owner has revised the Stormwater Management Report, if required, to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services; and c. community benefits and other matters in support of the development are secured in a Section 37 Agreement executed by the owner and registered on title to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor. 4. City Council authorize the City Solicitor and necessary staff to take such necessary steps, as required, to implement City Council's decision. Confidential Appendix A to the report (December 3, 2018) from the City Solicitor is now public and can be accessed under Background Information (City Council). The balance of Confidential Attachment 1 to the report (December 3, 2018) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation that affects the City or one of its agencies or corporations.

The purpose of this report is to seek instruction for a Local Planning Appeal Tribunal appeal on the above-noted municipal addresses.
Staff recommended
The City Solicitor recommends that: 1. Council adopt the recommendations contained in the Confidential Attachment 1 to this report; and 2. The recommendations contained in the Confidential Attachment 1 and Confidential Appendix "A" to this report be made public at such time as Council adopts the recommendations. All other information contained in the Confidential Attachment 1 is to remain confidential.
