City Council authorize the public release of: a. the confidential instructions to staff in Confidential Attachment 1 to the report (June 10, 2019) from the City Solicitor with the balance of Confidential Attachment 1 to the report (June 10, 2019) from the City Solicitor to remain confidential, as it contains advice subject to solicitor-client privilege; and b.

Confidential Attachment 2 to the report (June 10, 2019) from the City Solicitor. The confidential instructions to staff in Confidential Attachment 1 to the report (June 10, 2019) from the City Solicitor were adopted by City Council and are now public, as follows: 1. City Council direct the City Solicitor and other Staff to attend at the Local Planning Appeal Tribunal in support of the proposed revised policies to Official Plan Amendment 231 as set out in and substantially in accordance with Confidential Attachment 2 to the report (June 10, 2019) from the City Solicitor. 2. City Council direct the City Solicitor to continue negotiations with other appellants to the Conversion and Forecasting phase of the Official Plan Amendment 231 hearing in an effort to resolve all outstanding issues under appeal and to take all necessary steps to bring resolution to the matter in consultation with the Chief Planner and Executive Director of City Planning. Confidential Attachment 2 to the report (June 10, 2019) from the City Solicitor is now public and can be accessed under Background Information (City Council). The balance of Confidential Attachment 1 to the report (June 10, 2019) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.

City Council adopted Official Plan Amendment No. 231 (OPA 231) regarding Employment Areas in December 2013. OPA 231 is currently under appeal before the Local Planning Appeal Tribunal (LPAT or Tribunal). The Local Planning Appeal Tribunal has scheduled September 16 to October 4, 2019 to hear the remaining appeals regarding OPA 231 employment lands forecasting and policies pertaining to the conversion of employment lands.

Confidential Attachment 2.
