City Council authorize and direct the City Solicitor to attend the Toronto Local Appeal Body in order to oppose the appeal of the Committee of Adjustment's decision to refuse the minor variances requested in Application A0462/19NY regarding 82 Hanna Road. 2. City Council authorize the City Solicitor to retain such outside consultant as may be necessary to oppose the appeal.

This Motion will give the City Solicitor authority with appropriate City Staff to attend the Toronto Local Appeal Body in order to support the Committee of Adjustment's decision refusing certain variances sought in an application respecting 82 Hanna Road (Application A0462/19NY) (the "Application"). The Application sought variances to the City's Zoning By-law 569-2013 and Leaside Zoning By-law 1916 in order to permit the construction of a new dwelling.

As a result of revisions to the initial Application, Planning staff raised no concerns with the revised application's nine variances. On October 23, 2019, the North York District Panel of the Committee of Adjustment refused the variances. On November 12, 2019, the owner of 82 Hanna Road appealed the decision to the Toronto Local Appeal Body. The appeal, which will be considered by the Toronto Local Appeal Body, seeks to have the nine requested variances to the City-wide Zoning By-law 569-2013 and Leaside Zoning By-law 1916 granted, which would permit the construction of a new dwelling. This matter is urgent as the Toronto Local Appeal Body hearing is scheduled for March 9, 2020 and filing deadlines must be met in advance of that date.

Councillor Jaye Robinson, seconded by Councillor Gary Crawford, recommends that: 1. City Council authorize and direct the City Solicitor to attend the Toronto Local Appeal Body in order to oppose the appeal of the Committee of Adjustment's decision to refuse the minor variances requested in Application A0462/19NY regarding 82 Hanna Road. 2. City Council authorize the City Solicitor to retain such outside consultant as may be necessary to oppose the appeal.
