On December 13, 2018, the Committee of Adjustment (the "Committee") heard a minor variance application regarding the property municipally known as 25 Manhattan Drive (the "Subject Property"). The owner of the Subject Property (the "Applicant") sought relief from the former City of Scarborough, Wexford Community Zoning By-law No. 9511 and the City-wide Zoning By-law No. 569-2013 to permit the already expanded driveway in front of the existing dwelling (the "Application").

In a report prepared for the Committee from the Director of Community Planning, Scarborough District dated December 3, 2018, Planning Staff recommended that the Application be refused (the "Report"). The Report indicated that the Application's requested variances for the driveway width are not consistent with the prevailing characteristics of the established neighbourhood. Additionally, the Report indicated that the magnitude of the requested variances does not meet the general intent and purpose of the Official Plan and Zoning By-law, are not minor and do not represent appropriate development of the land. The Committee approved the Application (the "Decision").
