City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (June 19, 2020) from the City Solicitor. 3. City Council direct that the balance of Confidential Attachment 1 to the report (June 19, 2020) from the City Solicitor remain confidential as it contains advice that is subject to solicitor-client privilege.

The confidential instructions to staff in Confidential Attachment 1 to the report (June 19, 2020) from the City Solicitor were adopted by City Council and are now public, as follows: 1. City Council authorize an amendment to the Section 37 Agreement dated October 7, 2013 and registered as AT3461149 on November 25, 2013, between 1293446 Ontario Inc. and the City of Toronto ("Agreement"), to delete section 8 (option clause) in its entirety 2. City Council direct that save and except for the deletion of section 8 in its entirety, the remainder of the Agreement shall remain in full force and effect. 3. City Council direct that the amended Agreement be executed by the parties and registered on title under the same terms and conditions as the Agreement. The balance of Confidential Attachment 1 to the report (June 19, 2020) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.

At its meeting of October 8, 2013, Council approved the zoning by-law amendment application in this matter. The application proposed to construct a 45-storey mixed-use development with retail, cultural space and residential. It is comprised of a 29-storey tower atop a 16-storey base building that transitions to 14 storeys, then 4 storeys on George Street. The application proposed 767 residential units, 560 vehicular parking spaces and 786 bicycle parking spaces.
