In accordance with Section 195-8.4A of the Toronto Municipal Code Chapter 195 (Purchasing By-Law), granted authority to the Chief Engineer and Executive Director of Engineering and Construction Services to negotiate and enter into agreements with Hatch, being the highest overall scoring proponent meeting the requirements of Request for Proposal (RFP) No. 9117-19-7165, to provide detailed design, services during construction and post construction for the Midtown Toronto Relief Storm Sewer Project under Phase 4 of the Basement Flooding Protection Program (BFPP), in the amount of $28,653,248 net of HST and all applicable charges ($29,157,545 net of HST recoveries), including disbursements, provisional allowances and contingencies, as follows: a.

One (1) engineering agreement and one (1) purchase order for the detailed design and services during construction, in an amount not to exceed $28,214,181 net of HST, including labour, disbursements, provisional allowances and contingency amounts; and b.
