City Council on November 25 and 26, 2020, adopted the following: 1. City Council authorize the Director, Transaction Services to continue negotiation for the acquisition of the temporary property easements, as identified in Appendix A and as shown in the Draft Plan and the Aerial Map in Appendices B and C to the report (November 18, 2020) from the Executive Director, Corporate Real Estate Management and authorize if necessary to initiate expropriation proceedings, if the Executive Director, Corporate Real Estate Management deems it necessary or appropriate to proceed in that manner.

City Council authorize the Director, Transaction Services to serve and publish Notices of Application for Approval to Expropriate the Easements, to forward to the Chief Inquiry Officer any requests for hearing that are received, to attend any hearing in order to present the City of Toronto's position and to report the Inquiry Officer's recommendations back to City Council for its consideration.

As part of the Second Exit Project, the Toronto Transit Commission is proposing to make Donlands Subway Station safer and convenient by constructing a new second exit building. City Council authorization is required to acquire temporary property interests (the "Easements") to temporarily relocate gas utility lines in support of the Project. Subsequent to City Council's authorization in 2019 to expropriate property interests

for the construction of the Project, the Easements are new property interests, identified by the Toronto Transit Commission, and are necessary to install temporary gas utility lines to further facilitate the Project and provide power to the owners of the property on which the Easements are located during construction of the Project.
