The Toronto and East York Community Council: 1. Requested the City Solicitor to provide a confidential briefing, if necessary, or legal opinion to the members of the Toronto and East York Community Council at the September 15, 2020 meeting, regarding any legal implications that may arise from the refusal of a construction staging area permit in the municipal right of way for a private development.

Many Councillors in the Toronto and East York district are met with construction plans on numerous development sites which request the use of the public realm for an extended period of time, often putting residents at an inconvenience for many years. Before we can engage in discussions with developers about the potential to change or refuse staging permits, it would be prudent to have this discussion with City Legal.

Councillor Mike Layton, Ward 11, University-Rosedale recommends that Toronto and East York Community Council: 1. Request that the City Solicitor provide a confidential briefing or legal opinion to the members of TEYCC regarding any legal implications that may arise from the refusal of a construction staging area permit in the municipal right of way for a private development.
