City Council on March 10, 2021, adopted the following: 1. City Council adopt the confidential instructions to staff in Attachment 1 to the report (February 26, 2021) from the City Solicitor. 2. City Council authorize the public release of the confidential instructions to staff in Attachment 1 to the report (February 26, 2021) from the City Solicitor. 3. City Council direct that the balance of Confidential Attachment 1 and Confidential Appendix 1 to the report (February 26, 2021) from the City Solicitor remain confidential as they contain advice that is subject to solicitor-client privilege and information regarding pending litigation before the Local Planning Appeal Tribunal.

The confidential instructions to staff in Confidential Attachment 1 to the report (February 26, 2021) from the City Solicitor were adopted by City Council and are now public, as follows: 1. City Council authorize the City Solicitor to settle the appeals filed by Stafford Homes Limited, Diamante Development Corporation, and Insoho Developments Inc. against the enactment of By-law 515-2018, by accepting the Offer to Settle set out in Confidential Appendix 1 to the report (February 26, 2021) from the City Solicitor and City Council authorize the City Solicitor and the Chief Financial Officer and Treasurer to take all necessary action to facilitate the withdrawal of such Local Planning Appeal Tribunal appeals. The balance of Confidential Attachment 1 and Confidential Appendix 1 to the report (February 26, 2021) from the City Solicitor remain confidential in accordance with the provisions of the City of Toronto Act, 2006, as they contain advice that is subject to solicitor-client privilege and they contain information regarding pending litigation before the Local Planning Appeal Tribunal.

The purpose of this report is to seek instructions from City Council with respect to three appeals to the Local Planning Appeal Tribunal filed in respect of the City's Development Charges By-law 515-2018.
Staff recommended
The City Solicitor recommends that: 1. City Council adopt the confidential instructions to staff in Attachment 1; and 2. City Council authorize the public release of the confidential instructions to staff in Attachment 1, if adopted, with the remainder of the report including Appendix 1 to remain confidential as it contains advice that is subject to solicitor-client privilege and information regarding pending litigation before the Local Planning Appeal Tribunal.
