City Council direct that the balance of Confidential Attachment 1 to the report (April 28, 2021) from the City Solicitor remain confidential as it contains advice that is subject to solicitor-client privilege.

The confidential instructions to staff in Confidential Attachment 1 to the report (April 28, 2021) from the City Solicitor were adopted by City Council and are now public as follows: 1. City Council, pursuant to Subsection 45(1.4) of the Planning Act, permit an application for minor variance with respect to the property municipally known as 11-19 Altamont Road for relief from the requirements of Former North York Zoning By-law 7625, as amended by By-law 259-2020, and from the requirements of City of Toronto Zoning By-law 569-2013, as amended by By-law 260-2020, to amend the permitted height on site to allow the construction of an elevator pop-up. Confidential Appendix A to the report (April 28, 2021) from the City Solicitor is now public and can be accessed under Background Information (City Council). The balance of Confidential Attachment 1 to the report (April 28, 2021) from the City Solicitor remains confidential in accordance with the provisions of the City of the Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.

The purpose of this report is to seek further instruction in relation to a development application for 11-19 Altamont. This application is subject to an LPAT Order approving the zoning by-law amendment for the site, but the applicant is in continued discussion with the City with respect to how to implement the Tribunal's decision.

Staff recommended

The City Solicitor recommends that: 1. City Council adopt the confidential recommendations contained in Confidential Attachment 1. 2. City Council authorize the public release of the instructions in Confidential Attachment 1 and Confidential Appendix "A", if adopted by City Council, with the balance of the Confidential Attachment 1 to remain confidential as it contains advice which is subject to solicitor-client privilege.
