The purpose of this report is to seek further instruction in relation to a development application for a site that contains heritage resources, and a related ongoing appeal at the Local Planning Appeal Tribunal.
Staff recommended
The City Solicitor recommends that: 1. City Council state its intention to designate the properties at 10 and 10A Dawes Road under Part IV, Section 29 of the Ontario Heritage Act in accordance with the Statement of Significance: 10 and 10A Dawes Road (Reasons for Designation) attached as Public Appendix "D" to the report (April 28, 2021) from the City Solicitor. 2. If there are no objections to the designation, City Council authorize the City Solicitor to introduce the Bill in City Council designating the property under Part IV, Section 29 of the Ontario Heritage Act.

3. If there are objections in accordance with the Ontario Heritage Act, City Council direct the City Clerk to refer the designation to the Conservation Review Board. 4. If the designation is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend any hearing held by the Conservation Review Board in support of City Council's decision on the designation of the property. 5. City Council adopt the recommendations contained in the Confidential Attachment 1 to the report (April 28, 2021) from the City Solicitor. 6. City Council authorize the public release of the confidential recommendations contained in the Confidential Attachment 1, Confidential Appendix "A", Confidential Appendix "B" and Confidential Appendix "C", to the report (April 28, 2021) from the City Solicitor, if adopted by City Council, only at the discretion of the City Solicitor. 7. City Council direct that all other information contained in Confidential Attachment 1 to the report (April 28, 2021) from the City Solicitor is to remain confidential, as it contains advice which is subject to litigation and solicitor-client privilege.
