City Council on June 8 and 9, 2021, adopted the following: 1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (May 28, 2021) from the City Solicitor. 2. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (May 28, 2021) from the City Solicitor. 3. City Council direct that the balance of Confidential Attachment 1 to the report (May 28, 2021) from the City Solicitor remain confidential at the discretion of the City Solicitor, as it contains advice that is subject to solicitor-client privilege.

The confidential instructions to staff in Confidential Attachment 1 to the report (May 28, 2021) from the City Solicitor were adopted by City Council and are now public as follows: 1. City Council direct that Section 37 benefits in the amount of $1,050,000 be directed as follows a. $525,000 toward capital improvements for existing or new affordable housing within Ward 13; and b. $525,000 toward local streetscape, park and recreation centre improvements in Ward 13, including but not limited to Moss Park and John Innes Community Centre, in consultation with the local Councillor. 2. City Council direct that the amounts identified in Part 1 above, if not used within three (3) years, may be redirected for another purpose, at the discretion of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor, provided that the purpose is identified in the Toronto Official Plan and will benefit the community in Ward 13. 3. City Council direct that the amount identified in Part 1 above be increased upwards by indexing in accordance with the Non-residential Construction Price Index for the Toronto CMA, reported by Statistics Canada or its successor, calculated from the date of the Section 37 Agreement to the date the payment is made to the City. 4. City Council direct the City Solicitor to take any steps necessary to secure the above Section 37 benefits and any other matters required to implement the development on site in the implementing Zoning By-law as well as a Section 37 Agreement to be registered on title, all to the satisfaction of the City Solicitor. The balance of Confidential Attachment 1 to the report (May 28, 2021) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege. The balance of Confidential Attachment 1 to the report (May 28, 2021) from the City Solicitor will be made public at the discretion of the City Solicitor.

The purpose of this report is to seek further instruction from City Council with respect to the allocation of Section 37 benefits in the amount of $1,050,000 that have been approved by the Local Planning Appeal Tribunal. This report has been prepared in consultation with City Planning.

Staff recommended

The City Solicitor recommends that: 1. City Council adopt the confidential recommendations contained in Confidential Attachment 1. 2. City Council authorize the public release of the recommendations contained in the Confidential Attachment 1, if adopted by City Council, but that the remainder of the Confidential Attachment 1 remain confidential at the discretion of the City Solicitor, as it contains advice which is subject to solicitor-client privilege.
