The confidential instructions to staff in Confidential Attachment 1 to the report (June 1, 2021) from the City Solicitor were adopted by City Council and are now public as follows: 1. City Council accept the without prejudice proposed revisions to the terms of the settlement accepted by City Council on April 25, 2018, as set out in Confidential Attachment 2 to the report (June 1, 2021) from the City Solicitor and City Council direct the City Solicitor and other staff to attend at the Ontario Land Tribunal (formerly Local Planning Appeal Tribunal) in support of the revised settlement. 2. City Council authorize an amendment to the terms of the April 25, 2018 settlement regarding the allocation of the Section 37 contribution as follows: a. prior to the issuance of the first above grade building permit for the lands, the owner shall pay to the City a cash contribution of $4,900,000 dollars to be allocated as follows: i. $980,000 for the provision of affordable housing in the vicinity of the site; and ii. $3,920,000 towards any combination of the following, at the discretion, and to the satisfaction of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor: A. local parkland improvements and/or public realm improvements in the vicinity of the site, which may include David Crombie Park Revitalization and/or improvements to the Parliament Street underpass; and B. community services and facilities in the vicinity of the site. 3. City Council authorize the City Solicitor and relevant City staff to take such necessary steps, as required, to implement City Council's decision. Confidential Attachment 2 to the report (June 1, 2021) from the City Solicitor is now public and can be accessed under Background Information (City Council). The balance of Confidential Attachment 1 to the report (June 1, 2021) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.
