City Council on November 9, 10 and 12, 2021, adopted the following: 1. City Council authorize the entering into of a Licence Agreement of a term of twenty (20) years with Toronto Artscape Inc. as licensee, which includes a 20-year commitment to provide access to the Weston Common for the Weston Farmers' Market, and substantially on the terms and conditions outlined in Appendix A to Motion MM37.26, with such revisions thereto and such other terms acceptable to the Executive Director, Corporate Real Estate Management, or their designate from time to time, and in a form acceptable to the City Solicitor.

2. City Council authorize the Executive Director, Corporate Real Estate Management, or their designate, to administer and manage the Licence Agreement referenced in Part 1 above, including the provision of any consents, amendments, approvals, waivers, notices, and notices of termination, provided that the Executive Director, Corporate Real Estate Management, may, at any time, refer consideration of such matters to City Council for its determination and direction. 3. City Council individually authorize each of the Executive Director, Corporate Real Estate Management and the Director, Real Estate Services, to execute the Licence Agreement referenced in Part 1 above and any related documents on behalf of the City of Toronto.

As part of the redevelopment of 22 John Street authorized by City Council in 2015, a lease for the Weston Cultural/Community Hub space at adjacent 33 King Street ("Weston Hub") was entered into between the owner of 33 King Street as landlord, the developer, and Toronto Artscape Inc. ("Artscape") as tenant, for a term of fifty (50) years less one day. The Weston Hub, operated by Artscape, is a cultural hub in the heart of Weston.

It provides a platform for local creative talent to thrive, as well as reflecting the rich history and diversity of the Weston community. The adjacent City-owned community outdoor space ("Weston Common") is also the home of the Weston Farmers' Market, the second-oldest market in the City of Toronto, opening annually for over forty years. Generations of families have visited the farmers' market on the weekend to enjoy the farm-fresh produce, meet local artisans, and engage with an array of vendors. Artscape is a not-for-profit urban development organization, which provides space for artists and creators. It is important that the Weston Common remains open and accessible for the Weston community in the most efficient manner. The long term licence agreement to Artscape will include access to third party event organizers, and include a 20-year commitment to provide access to the Weston Common for the Weston Farmers' Market, which will ensure that the community can continue to have access to the Weston Farmers' Market. This license agreement will resolve communication issues between event organizers, Artscape, and the City of Toronto, and it will ensure that the space remains vibrant and inclusive for all.
