As the city filed it

This motion will authorize the City Solicitor to support the Committee of Adjustment's decision refusing the minor variance application at 23 Fielding Avenue and attend the Toronto Local Appeal Body in order to oppose the Application. The Application seeks to alter the existing two storey semi-detached dwelling by proposing a rear two storey addition, a rear ground floor deck, and a rear one storey detached garage. The Application required the COA's approval of four (4) proposed variances to Zoning By-law 569-2013.

Planning staff did not file a report to the COA with respect to the Application, however the committee carefully considered the evidence of numerous neighbours who would be directly impacted and found that, while the variances appear minor on paper the impact on the neighbourhood was not minor. The COA refused the Application in its decision issued on June 2, 2021. Subsequently, the owner of 23 Fielding Avenue appealed the Decision to the TLAB. This Motion will direct the City Solicitor to attend the TLAB in order to oppose the Appeal. No hearing date has been scheduled yet.
