City Council on March 9, 2022, adopted the following: 1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (March 1, 2022) from the City Solicitor. 2. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1, and Confidential Appendices A, B, and C to the report (March 1, 2022) from the City Solicitor, including any part of them, at the discretion of the City Solicitor.

3. City Council direct that the balance of Confidential Attachment 1 to the report (March 1, 2022) from the City Solicitor remain confidential at the discretion of the City Solicitor, as it contains advice that is subject to solicitor-client privilege. The Confidential instructions to staff in Confidential Attachment 1 to the report (March 1, 2022) from the City Solicitor were adopted by City Council. The following confidential instructions to staff have been made public, the City Solicitor having exercised the City Solicitor's discretion to make them public: 1. City Council authorize the City Solicitor to request the Ontario Land Tribunal to modify and partially approve the non-policy text, policies and maps in Official Plan Amendment 499 substantially in accordance with Confidential Appendix A to the report (March 1, 2022) from the City Solicitor. 2. City Council authorize the City Solicitor to make such stylistic and technical changes to the proposed modifications to Official Plan Amendment 499 in Confidential Appendix A to the report (March 1, 2022) from the City Solicitor as deemed necessary by and at the sole discretion of the City Solicitor in consultation with the Chief Planner and Executive Director, City Planning. 7. City Council direct the City Solicitor to continue discussions with Official Plan Amendment 499 appellants in an effort to resolve their remaining issues, and to take all necessary steps to bring resolution to the matter, in consultation with the Chief Planner and Executive Director, City Planning. Confidential Appendix A to the report (March 1, 2022) from the City Solicitor is now public, the City Solicitor having exercised the City Solicitor's discretion to make it public, and it can be accessed under Background Information (City Council). The balance of Confidential Attachment 1, including the balance of the confidential instructions to staff adopted by City Council, and Confidential Appendices B and C to the report (March 1, 2022) from the City Solicitor remain confidential at this time in accordance with the provisions of the City of Toronto Act, 2006. The balance of Confidential Attachment 1 and Confidential Appendices B and C to the report (March 1, 2022) from the City Solicitor will be made public at the discretion of the City Solicitor. September 16, 2022 The following confidential instructions to staff in Confidential Attachment 1 to the report (March 1, 2022) from the City Solicitor have been made public, the City Solicitor having exercised the City Solicitor's discretion to make them public: 3. City Council authorize the City Solicitor to request the Ontario Land Tribunal to modify and partially approve the non-policy text, policies and maps in Official Plan Amendment 499 arising from Confidential Appendix B to the report (March 1, 2022) from the City Solicitor, provided that the Chief Engineer and Executive Director, Engineering and Construction Services receives a satisfactory Master Servicing Report or equivalent for the Golden Mile Area for such lands impacted by the modifications in Confidential Appendix B to the report (March 1, 2022) from the City Solicitor and subject to Part 4 below. 4. City Council authorize the City Solicitor to make such stylistic and technical changes to the proposed modifications to Official Plan Amendment 499 in Confidential Appendix B to the report (March 1, 2022) from the City Solicitor, including any necessary adjustments to reduce the maximum building heights in some or all parts of the Golden Mile Secondary Plan Area, as deemed necessary by and at the sole discretion the Chief Planner and Executive Director, City Planning and the City Solicitor, in consultation with the Chief Engineer and Executive Director, Engineering and Construction Services. 8. City Council request the General Manager, Parks, Forestry, and Recreation to include within the Capital Plan, the provision of a new community recreation centre within the Golden Mile Secondary Plan Area in future budget submissions for Parks, Forestry, and Recreation and some or all funding be collected through development charges for such community recreation centre, and to explore other financial tools to fund the provision of such community recreation centre. 9. City Council request the General Manager, Toronto Water and the Chief Engineer and Executive Director, Engineering and Construction Services to include within the Capital Plan, the provision of any required trunk sewer upgrades or major capital upgrades, including any required Environmental Assessment studies, arising from the satisfactory and accepted Master Servicing Report or equivalent for the Golden Mile Area in future budget submissions for Engineering and Construction Services and some or all funding be collected through development charges for such municipal servicing upgrades. Confidential Appendix B to the report (March 1, 2022) from the City Solicitor is now public, the City Solicitor having exercised the City Solicitor's discretion to make it public, and it can be accessed under Background Information (City Council).

On October 27, 28 and 30, 2020, City Council adopted Official Plan Amendment No. 499, which, among other matters, created Chapter 6, Section 45, Golden Mile Secondary Plan. The Secondary Plan was subsequently appealed to the Ontario Land Tribunal (the "OLT") by 20 appellants and the OLT added three additional parties. The purpose of this report is to request further instructions in this matter which is the subject of an appeal to the OLT.
Staff recommended
The City Solicitor recommends that: 1. City Council adopt the recommendations contained in the Confidential Attachment 1 to the report (March 1, 2022) from the City Solicitor. 2. City Council authorize the public release of the confidential recommendations contained in the Confidential Attachment 1, Confidential Appendix A, Confidential Appendix B, and Confidential Appendix C to the report (March 1, 2022) from the City Solicitor, if adopted by City Council, including any part thereof, at the discretion of the City Solicitor.
