City Council direct that the balance of Confidential Attachment 1 to the report (May 30, 2022) from the City Solicitor remain confidential as it contains advice that is subject to solicitor-client privilege.

The confidential instructions to staff in Confidential Attachment 1 to the report (May 30, 2022) from the City Solicitor, were adopted by City Council and are now public as follows: 1. City Council approve the alterations to the heritage properties at 1134 and 1140 Yonge Street in accordance with Section 33 of the Ontario Heritage Act to allow for alterations substantially in accordance with the plans and drawings dated April 27, 2022, prepared by Audax Architects Inc., on file with the Senior Manager, Heritage Planning, Urban Design, City Planning and the Heritage Impact Assessment prepared by ERA Architects Inc. dated April 27, 2022, and on file with the Senior Manager, Heritage Planning, Urban Design, City Planning, all subject to and in accordance with the Conservation Plan satisfactory to the Senior Manager, Heritage Planning, Urban Design, City Planning. 2. City Council authorize the entering into of a Heritage Easement Agreement under Section 37 of the Ontario Heritage Act with the owner of the property at 1134 and 1140 Yonge Street, in a form satisfactory to the City Solicitor and content satisfactory to the Chief Planner and Executive Director, City Planning. 3. City Council authorize the City Solicitor to introduce the necessary Bill in City Council authorizing the entering into of a Heritage Easement Agreement for the properties at 1134 and 1140 Yonge Street. The balance of Confidential Attachment 1 to the report (May 30, 2022) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.

The purpose of this report is to seek instruction with respect to an application to alter a property that has been designated under Part 4 of the Ontario Heritage Act. Authority is also requested to enter into a Heritage Easement Agreement for the properties at 1134 and 1140 Yonge Street. The owner has provided a revised development proposal that proposes the retention of the heritage designated buildings. The revised development proposal has been considered by City Council, in the form of the owner's settlement offer to the City, which has been accepted by City Council.
