On April 19, 2022, the applicant filed an application, in respect of 2500 Don Mills Road, for Official Plan and Zoning By-law Amendments. The Zoning By-law Amendment intended to permit 30- (96.06 metres) and 39-storey (123 metres) towers on a shared podium, containing a total of 823 residential units and some non-residential space. The Official Plan Amendment proposed amendments to Section 4.2.10 of the Sheppard East Corridor Secondary Plan to increase the planned density for the Site from 3.99 times the area of the lot to 7.35 times the area of the lot, and to plan for the delivery of public streets not only through the Subdivision process, but also by way of the Site Plan Control process.

The applicant appealed City Council's neglect or failure to make a decision on the Application, to the Ontario Land Tribunal on February 6, 2023. The City Solicitor requires further directions for the upcoming Ontario Land Tribunal hearing, which is scheduled to commence on October 21, 2024.

The City Solicitor recommends that: 1. City Council adopt the confidential instructions to staff contained in the Confidential Attachment 1 to this report from the City Solicitor. 2. City Council authorize the public release of the confidential instructions to staff contained in Confidential Attachment 1 Confidential Appendix A, Confidential Appendix B, and Confidential Appendix C to this report from the City Solicitor, if adopted by City Council.
