This Motion will give the City Solicitor authority to appeal the Committee of Adjustment's decision approving demolishing the existing dwelling and constructing a new two-storey dwelling at 187 Oakridge Drive (Application A0215/24SC) and to attend the Toronto Local Appeal Body, along with appropriate City Staff, to oppose the Application. The Application seeks to demolish an existing dwelling and construct a new two storey dwelling.

The Application proposes a floor space index of 457.25m2 where By-law 569-2013 only permits a maximum floor space index of 0.4 times the lot area if the lot area is more than 697 m² (341.44 m²). On November 13, 2024, the Committee of Adjustment issued a decision approving the Application, subject to conditions. A copy of the Notice of Decision of the Committee of Adjustment is attached. In order to preserve the City's right of appeal, the City Solicitor appealed the Committee of Adjustment's Decision to the Toronto Local Appeal Body on December 2, 2024. This matter is time sensitive and urgent as the City Solicitor has already appealed the Decision to the Toronto Local Appeal Body to preserve the City's statutory right and requires instructions to appeal and attend the hearing for this matter. This motion is urgent as the City Solicitor's office has to prepare to appeal a Committee of Adjustment decision before Toronto Local Appeal Body.
