City Council on December 17 and 18, 2024, adopted the following: 1. City Council direct the City Solicitor to seek party status at the Toronto Local Appeal Body, and to attend the Toronto Local Appeal Body hearing, with appropriate City staff, in opposition to the appeal of the Committee of Adjustment's decision to refuse the Minor Variance application in Application A0529/24TEY respecting 30 Charles Street East. 2. City Council authorize the City Solicitor to retain outside consultants as necessary.

On October 1, 2024, the Committee of Adjustment refused a variance application No. A0529/24TEY (the "Application") brought by the owners of 30 Charles Street East which sought to permit the construction of an additional rental unit. The owner has appealed this decision to the Toronto Local Appeal Body (the "TLAB"). The owner has a history of failing to provide its tenants with vital services, including heat and working plumbing, failing to comply with city orders, and attempting to force existing tenants to leave the building.

The tenants have requested the City's support to oppose the appeal. This motion will authorize the City Solicitor to attend the TLAB with appropriate City Staff or outside consultants, in order to oppose the minor variances requested in the Application. This motion will also give the City Solicitor authority to negotiate a settlement of the appeal and retain outside consultants as necessary. This matter is time sensitive and urgent as the City Solicitor requires instructions to seek party status in the appeal and subsequently attend the hearing in opposition to the proposal.
