This Motion will give the City Solicitor authority to attend the Toronto Local Appeal Body in order to oppose the appeal of the Committee of Adjustment's decision to refuse the minor variance application at 321 Laird Drive (Application A0406/23NY) (the "Application") and to retain outside consultants as necessary. This Motion will also authorize the City Solicitor to resolve the matter on behalf of the City, at the City Solicitor's discretion, after consultation with the Ward Councillor and the Director of Community Planning, North York District.

The applicant applied to the Committee of Adjustment requesting four minor variances from City-wide Zoning By-law 569-2013, in order to construct a two-storey addition, in conjunction with other interior and exterior alterations, at 321 Laird Drive. On September 26, 2024, the Committee of Adjustment refused the Application. A copy of the Committee of Adjustment's decision is attached as Attachment 1. The applicant has appealed the refusal to the Toronto Local Appeal Body. Community Planning did not submit a Staff Report on this matter, and for the City to continue to effectively assess and call its case, the City Solicitor requires the expertise of an external consultants to advise on the applicant's proposed plan, and to potentially make recommendations respecting a solution. This Motion is urgent as the Toronto Local Appeal Body has issued a Notice of Hearing for this matter. The deadline for the City to seek party status was on November 27, 2024, the deadline for expert witness statements is December 27, 2024, and the hearing is scheduled to proceed on February 11, 2025. The Notice of Hearing is attached as Attachment 2.
