City Council on April 17 and 18, 2024, adopted the following: 1. City Council amend the Official Plan for the lands at 461 Sheppard Avenue East substantially in accordance with the draft Official Plan Amendment attached as Attachment 5 to the report (March 11, 2024) from the Director, Community Planning, North York District. 2. City Council amend Zoning By-law 569-2013 for the lands at 461 Sheppard Avenue East substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 6 the report (March 11, 2024) from the Director, Community Planning, North York District, as amended by Parts 3 and 4 below.

3. City Council amend the Bill attached as Attachment 6 to the report (March 11, 2024) from the Director, Community Planning, North York District, to require a minimum of 14 visitor parking spaces and to permit car-share parking spaces at 461 Sheppard Avenue East. 4. City Council amend the Bill attached as Attachment 6 to the report (March 11, 2024) from the Director, Community Planning, North York District, to remove the Holding Provision (H). 5. City Council determine that the revisions to the By-law noted in Parts 3 and 4 above are minor in nature and pursuant to Section 34(17) of the Planning Act, no further public notice is required in respect of the proposed Zoning By-law Amendment. 6. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and/or draft Zoning By-law Amendment as may be required. 7. City Council request the Mayor to consider allocating any Community Benefit Charge funds collected from this development toward a potential on-site subway tunnel access through the annual budget process immediately following the payment of the funds to the City. 8. City Council request the General Manager, Transportation Services report to the North York Community Council to review and report back on the feasibility of excluding the development located at 461 Sheppard Avenue East from Permit Parking should it be implemented on an area or street-based basis in the future.

This application proposes to amend the City of Toronto Official Plan and Zoning By-law to permit a 44-storey (144 metres including mechanical penthouse) mixed use building at 461 Sheppard Avenue East. The proposed building would consist of 513 dwelling units and have a gross floor area of 29,151 square metres, including 372 square metres of ground floor retail gross floor area, for a Floor Space Index of 13.07. The proposed development is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020).

This report reviews and recommends approval of the application to amend the Official Plan and Zoning By-law. The proposed building represents an appropriate level of intensification on the site given its proximity to Bayview Subway Station, location within the Council-adopted Bayview Major Transit Station Area and has been designed to provide an enhanced public realm at a prominent node.
