City Council on July 23 and 24, 2025, adopted the following: 1. City Council amend City of Toronto Zoning By-law 569-2013 for the lands at 101-105 Spadina Avenue and 363 Adelaide Street West, substantially in accordance with the draft Zoning By-law Amendment included as Attachment 5 to the report (June 17, 2025) from the Director, Community Planning, Toronto and East York District. 2. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

3. City Council approve a development charge credit against the Parks and Recreation component of the Development Charges for the design and construction by the owner of the Above Base Park Improvements to the 1,000 square metre public park located at the northern portion of the site, to the satisfaction of the General Manager, Parks and Recreation; the development charge credit shall be in an amount that is the lesser of the cost to the owner of designing and constructing the Above Base Park Improvements, as approved by the General Manager, Parks and Recreation, and the Parks and Recreation component of development charges payable for the development in accordance with the City's Development Charges By-law, as may be amended from time to time.

This report reviews and recommends approval of the application to amend the Zoning By-law to permit a 50-storey mixed use building with 452 dwelling units and 127 square metres of retail space at 101-105 Spadina Avenue and 363 Adelaide Street West. This site was previously approved in 2023 for a 39-storey mixed use building. The site was subject to a real estate transaction in December 16, 2020 between the applicant and the City of Toronto which reconfigured the existing parcels of land to facilitate the proposed development and also a 1,000 square metre City park on the northern portion of the site fronting Spadina Avenue and Adelaide Street West.

There are no changes to the proposed City park being contemplated through this application to amend the Zoning By-law. A Toronto Parking Authority (TPA) parking facility will occupy 2 levels of the proposed 5 level underground garage.
