The purpose of this report is to advise Community Council concerning an application by the property owner of 751 Scarlett Road for a site-specific Fence Exemption, pursuant to Section 447-1.2C.(1) of Toronto Municipal Code, Chapter 447 - Fences. The property owner is seeking Community Council's permission to maintain an existing solid masonry stone clad wall located on the north side of the driveway within the front yard. The wall is situated within 2.4 metres of the driveway and does not comply with the requirement to provide an open mesh chain-link fence or equivalent open-construction fence within this area. This requirement is intended to preserve clear sightlines and prevent obstruction of views of the adjacent boulevard or highway. The existing wall has been determined to create a sightline obstruction. Municipal Licensing and Standards Division staff have conducted an inspection of the property and have issued a Notice of Violation for non-compliance with the applicable provisions of Chapter 447.

Staff recommended

The District Manager, Municipal Licensing and Standards, West District recommends that Etobicoke York Community Council: 1. Refuse to grant the application for exemption by the owner of 751 Scarlett Road because the fence fails to comply with the provisions of Toronto Municipal Code, Chapter 447 Fences.
