City Council on May 20 and 21, 2026, adopted the following: 1. City Council amend City of Toronto Zoning By-law 569-2013 for the lands at 390, 394, 396 and 398 Spadina Road substantially in accordance with the draft Zoning By-law Amendment included as Attachment 5 to the report (April 14, 2026) from the Acting Director, Community Planning, Toronto and East York District. 2. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

3. City Council require the owner to provide a Tenant Assistance Plan for tenants of the 5 existing rental dwelling units proposed to be demolished to the satisfaction of the Chief Planner and Executive Director, City Planning. 4. City Council direct that before introducing the necessary Bills to City Council for enactment, the applicant be required to enter into a legal agreement, or alternately, provide a lawyer's undertaking to the City, to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning, securing the implementation of the Tenant Assistance Plan required by Part 3 above. 5. City Council request the Executive Director, Development Review to confirm with the Ward Councillor, the South Forest Hill Residents Association and the residents of 60 Montclair Avenue that the transportation aspects of the proposal are satisfactory, including conducting additional traffic impact assessment accounting for peak neighbourhood congestion conditions, impacts of the use of the Type C loading space, and the securing of private garbage collection. 6. City Council request the Executive Director, Development Review to secure at-grade retail space demised for three retail units each with independent access, and to secure a minimum of three retail entrances in the Site-specific Zoning By-law. 7. City Council request the Executive Director, Development Review, in consultation with the Chief Planner and Executive Director, City Planning, to secure the following obligations through the Site Plan Control process: a. all of the public realm improvements along Spadina Road and Montclair Avenue shown on the Landscape Plans prepared by addesso design inc., dated 2025-09-29, with the exception of the designated garbage storage area shown along Montclair Avenue; b. the following building improvements as shown on the renderings shown on sheet A0-001, forming part of the architectural drawings by Giannone Petricone Associates Inc. Architects, dated 2025-09-30: 1. recessed and/or "punched" window openings that add depth to the façade; 2. recessed brick window jambs (three course of bricks) at podium windows; 3. natural stone base; 4. solid signage fascia panels with decorative (green in rendering) finish; and 5. canopies/awnings at residential and retail entrances. 8. City Council request the Executive Director, Development Review, in consultation with the local Ward Councillor and the City Solicitor, to work with the applicant to explore an in-kind community benefit contribution pursuant to Section 37(6) of the Planning Act, in consultation with the Neighbourhood Liaison Committee, and to report back to City Council for further instruction on any offer of in-kind community benefits made by the applicant. 9. City Council request the Owner to develop a Construction Mitigation Plan during Site Plan Control in consultation with the residents of Montclair Avenue and to the satisfaction of the Executive Director, Development Review, which Construction Mitigation Plan must at least include provision for: a. a parking plan to mitigate the impacts of construction of the development on the residents of Montclair Avenue; b. keeping Nick Vitantonio laneway open and clear to the residents of 60 Montclair Avenue, who rely on the use of the laneway for accessibility for residents with mobility challenges and deliveries, and if its closure may be determined to be necessary, that the residents of 60 Montclair Avenue be provided with a temporary accessible entrance by the applicant to be secured through the Construction Management Plan; c. providing safe and clean pedestrian access along Montclair Avenue at all times during construction; d. regular cleaning and repair of the streets and sidewalks; and e. providing adequate notice to the residents prior to any major construction disruptions; and f. repairing Montclair Avenue to City standards post-construction. 10. City Council request that the Owner establish a Neighbourhood Liaison Committee, as part of the Site Plan approval process, including but not limited to the South Forest Hill Residents Association and the residents at 60 Montclair Avenue, in consultation with the Ward Councillor, the General Manager, Transportation Services and the Executive Director, Development Review, and be required to consult the committee on the following issues: a. the public realm and building improvements; b. the in-kind contribution; and c. the Construction Mitigation Plan. 11. City Council request the Owner to continue discussions with the owner of 404 Spadina during the Site Plan Application on items including podium treatment, setbacks, privacy, and vehicle access impacts.

This report recommends approval of the application to amend the Zoning By-law to permit a 49.2-metre (14-storeys excluding mechanical penthouse) mixed-use building at 390, 394, 396 and 398 Spadina Road. The proposed building includes 54 residential units, with a total gross floor area of 9,430 square metres, including 584 square metres of gross floor area for non-residential uses.
