15 and 35 Trehorne Drive Encroachment Agreement
Scarlett Heights (15 Trehorne Drive), a former high school site, was declared surplus by the Toronto District School Board on June 29, 2022. The Toronto Catholic District School Board provided an expression of interest on February 10, 2023, to acquire the Scarlett Heights building and property to address its student accommodation needs, including the establishment of a new high school. As part of the process, the Board decided that new property lines be established for the property containing the Scarlett Heights school building and Hilltop Middle School (35 Trehorne Drive) to create two parcels; allowing the east parcel containing the former high school to be declared surplus and sold. The Etobicoke York Committee of Adjustment approved the Consent Application on Condition on August 2, 2023, under file B0004/23EYK. Among the conditions is a requirement to convey land to the City: The owner shall convey to the City, at nominal cost, a 0.40 metre wide strip of land along the Royal York Road frontage of the property in order to satisfy the requirements of a 27 metre wide future right-of-way in fee simple, such lands to be free and clear of all physical and title encumbrances, and subject to a right-of-way for access in favour of the Grantor until such time as said lands have been dedicated as a public highway, all to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services and the City Solicitor. A manhole which provides access to the site stormwater connection has been found to be located on the edge of the site, within the 0.40 metre wide strip of land to be conveyed to the City as part of the conditions for consent. The manhole is considered a private encumbrance, and must be addressed in order to satisfy the condition. The purpose of this motion is to provide City Staff with the authority to enter an encroachment agreement for the manhole. Community Council has delegated authority from City Council to make a final decision. Compliance with the conditions of consent are time sensitive. Moreover, completion of the surplus and sale of lands for a high school site are of civic importance, and any delay can have material impact to the community and to the school boards.
The Etobicoke York Community Council: 1. Directed the General Manager, Transportation Services, to negotiate and enter into an Encroachment Agreement with the property owner at 15 and 35 Trehorne Drive to maintain private manhole in the municipal boulevard abutting the Royal York Road frontage of the property after the land has been conveyed.

20 Thomas Riley Road - Designation of Fire Routes and amendment to Chapter 880 - Fire Routes
To obtain Etobicoke York Community Council approval for the amendment of the Fire Route By-law to designate certain locations as fire routes within the meaning of City of Toronto Municipal Code Chapter 880, as amended. Fire Services uses designated fire routes as a key mechanism in regulating fire prevention, including the prevention of spreading of fires and the delivery of fire protection services.

140 The Queensway - Residential Demolition Application
This staff report is for a matter for which the Etobicoke York Community Council has the delegated authority to make a final decision. In accordance with Residential Demolition Control, as specified under the City of Toronto Municipal Code, Chapter 363, Article 6 'Demolition Control' and pursuant to the authority of Section 33 of the Planning Act, the application for the demolition of two existing detached residential buildings, a single-storey building and a two-storey building located at 140 The Queensway (Application No. 24 167946 DEM), is being referred to the Etobicoke York Community Council. Etobicoke York Community Council has the authority to either refuse or approve the demolition applications. The reason for this report is that a building permit has not yet been issued for a replacement building at 140 The Queensway.
The Etobicoke York Community Council: 1. Approved the application to demolish the two vacant residential buildings at 140 The Queensway without any conditions.

The Deputy Chief Building Official and Director of Toronto Building, Toronto East York District, and Strategic Priorities recommends that the Etobicoke York Community Council consider the demolition application and decide to: 1. Refuse the application to demolish the two vacant residential buildings at 140 The Queensway because there is no building permit issued to replace the existing buildings on the site; or 2. Approve the application to demolish the two vacant residential buildings at 140 The Queensway without any conditions; or 3. Approve the application to demolish the two vacant residential buildings at 140 The Queensway with the following conditions: a) That construction fences be erected in accordance with the provisions of the Toronto Municipal Code, Chapter 363, Article 7, if deemed appropriate by the Chief Building Official; b) The immediate removal of all debris and rubble after demolition; c) The laying of sod on the site and maintenance of the site free from garbage and weeds, in accordance with the Municipal Code Chapter 629-10, paragraph B and 629-11; and d) The backfilling of any holes on the property with clean fill.

Parking Regulation Amendments - Pine Street between Church Street and Woodward Avenue
I am requesting your support to amend the parking regulation along the east side of Pine Street between Church Street and Woodward Avenue. My office has received numerous complaints regarding illegal parking on the east side of Pine Street, vehicles exceeding the 3 hour limit and parking to close to the intersection causing visibility and safety issues. Despite multiple parking enforcement efforts, my office continues to receive resident complaints about illegal parking.
The Etobicoke York Community Council: 1. Amended the existing parking prohibition in effect at all times, on the east side of Pine Street a point 70.1 metres north of Church Street and Woodward Avenue, to be in effect between Church Street and Woodward Avenue.
