Residential Demolition Application - 414 Kenneth Avenue
This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision. In accordance with Section 33 of the Planning Act and the former City of Toronto Municipal Code Ch. 363, Article 6 "Demolition Control", the application for the demolition of a single family dwelling at 414 Kenneth Avenue is being referred to the North York Community Council to consider as a building permit has not been issued for a replacement building. North York Community Council may impose conditions, if any, to be attached to the demolition permit.
North York Community Council: 1. Refused the application to demolish the single family dwelling because there is no permit to replace the building on the site.

The Toronto Building Division recommends that the North York Community Council give consideration to the demolition application for 414 Kenneth Avenue and decide to: 1. Refuse the application to demolish the single family dwelling because there is no permit to replace the building on the site; or, 2. Approve the application to demolish the single family dwelling without conditions; or 3. Approve the application to demolish the single family dwelling with the following conditions: a. that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article 7, if deemed appropriate by the Chief Building Official; b. that all debris and rubble be removed immediately after demolition; c. that sod be laid on the site and be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 489; and d. that any holes on the property are backfilled with clean fill.

Request for a Fence Exemption to the Toronto Municipal Code, Chapter 447 - 20 Murray Road
This staff report concerns a matter for which the North York Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to advise Community Council concerning an application by the property owner of 20 Murray Road for a site-specific Fence Exemption, pursuant to Section 447-1.5(B) of Toronto Municipal Code, Chapter 447- Fences. The property owner is seeking Community Council's permission to install a new fence, which does not comply with the standards stipulated by Section 447-1.3(B)(1) of the bylaw. The fence exceeds the allowed height limits and will be installed on the East side of the property along Murray Road. The fence material is metal cladding with steel posts and metal strapping.
North York Community Council: 1. Granted the application for a fence exemption permit (with or without conditions) to the property owner of 20 Murray Road, thereby allowing the fence to be installed as indicated. Direct and require that the installation be maintained in good repair without alteration. At such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, Fences or its successor by-law.

This staff report is in regards to a matter for which the North York Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application submitted by the homeowner of 134 Rykert Crescent requesting access from the property's home to the pool enclosure area in the rear yard remain without a fourth fence. The pool enclosure does not meet the requirements specified in City of Toronto Municipal Code, Chapter 447, Fences. (Table #1 for violation deficiency and By-law section).
North York Community Council: 1. Granted the exemption to the homeowners of 134 Rykert Crescent to allow access through openings in the wall of the building to the pool enclosure area in the rear yard to remain without the benefit of a fourth fence. If at any time a replacement of any fence forming part of the pool enclosure is required, that the replacement fence will comply with Municipal Code Chapter 447, Fences or its successor by-law.

Application to Injure a Private Tree - 1399 Bayview Avenue
This report requests that City Council approve the request for a permit to injure one privately owned tree located at 1399 Bayview Avenue. The application indicates the reason for injury is to accommodate the replacement of a portion of the existing stone wall along the western side of the property; to install new stairs overtop of an existing concrete foundation and new concrete paving to connect with an existing walkway. The subject tree is a white oak tree (Quercus alba) measuring 118 cm in diameter. It is a Heritage Tree as defined in Article III, Chapter 813, Trees, of the City of Toronto Municipal Code. Under the provisions of Chapter 813, the General Manager shall not issue a permit for the injury or destruction of trees where the tree is a heritage tree, or should in the opinion of the General Manager be recommended for designation as a heritage tree.
