This report is to provide the Board of Directors of Toronto Parking Authority with further information and updates regarding the insolvency proceeding commenced by the construction lenders bcIMC Construction Fund Corporation ("bcIMC") and Otera Capital Inc. ("Otera") against the owners of the property municipally known as 50 Cumberland Street/37 Yorkville Avenue (the "Property"), namely, 33 Yorkville Residences Inc. and 33 Yorkville Residences Limited Partnerships (the "33 Yorkville Cresford Subsidiaries"). Information about this insolvency proceeding was first provided in a joint report from the Acting President, Toronto Parking Authority, and the City Solicitor entitled "Transaction Update on City-Owned 50 Cumberland Street/37 Yorkville Avenue (Municipal Car Park 15)" dated March 13, 2020 (Item PA14.4, the "First Report") and in a verbal update to the Board at its May 15, 2020 special meeting. The insolvency proceeding has continued since those dates. Weekend Rate Adjustments - Off-Street Municipal Parking Facilities
At its meeting on June 3, 2020, Toronto Parking Authority (TPA) Board of Directors approved amendments to TPA Policy Resolution 2-1 - Parking Rates - Off-Street Facilities. The approved amendments include a framework for the use of a weekend benchmark to guide the establishment and use of weekend rates where there is an opportunity to increase demands at underutilized car parks while at the same time supporting local businesses and destination commercial retail. Pricing weekend rates to manage occupancy is consistent with TPA's mandate and other rate setting objectives, which support local businesses while discouraging discretionary commuter travel by vehicle. TPA has carried out a review of its car parks that either have weekend rates or have comparable competitors operating in the area that have weekend rates and is recommending that TPA Board of Directors approve a number of rate adjustments that will ensure that the pricing structure at these locations is consistent with TPA's rate setting policy and better position TPA's car parks to attract parking demands on the weekends. The proposed rate changes will impact 30 car parks and are summarized in Attachment 1, Proposed Weekend Day Maximum Rate Changes and Justifications and Attachment 2, Proposed Weekend Evening Maximum Rate Changes and Justifications.

Approved the weekend parking rate adjustments in the amounts and at the parking facilities identified in Attachments 1 and 2 to the report (July 10, 2020) from the Acting President, Toronto Parking Authority, and directed the President, Toronto Parking Authority, to implement these rate changes anticipated to commence in August 2020.

This report seeks Toronto Parking Authority (TPA) Board of Directors approval to enter into a one (1) year term parking management agreement (the Agreement) to provide parking management services for a 123-space surface parking lot located at 115 Unwin Avenue (the Property), known as Municipal Car Park 243, with CreateTO (on behalf of the City of Toronto Economic Development Corporation (TEDCO) operating as Toronto Port Lands Company (TPLC)) (the Owner). The Agreement will continue TPA's management of Car Park 243, which originally started in 2010, and has previously been continued through a series of one- and two-year term agreements. While the overall financial value of the agreements has been low, TPA's provision of parking management services represents an important community benefit in the Port Lands. The proposed Agreement with the Owner will be in accordance with the terms and conditions outlined in this report and Appendix A.

Agreement and Amendment to Extend Agreement with Brink's Canada Limited for Coin and Note Processing
Brink's Canada Limited (Brink's) is currently responsible for sorting, counting, rolling, and banking of the cash revenue collected from Toronto Parking Authority's (TPA) on- and off-street payment machines. These services have been contracted out since 1998. In 2011, TPA's Board of Directors approved the contract award for coin processing services to Brink's under a three (3)-year agreement. In 2014, as Brink's performance had met expectations, the Board of Directors authorized TPA to renew the existing coin processing contract for an additional four (4) year term. This report seeks approval from TPA Board of Directors to amend the previously authorized agreement for coin and note processing with Brink's to extend the term of this agreement for an additional two (2) years from April 30, 2018 to April 30, 2020. Since May 1, 2018, TPA has been operating and retaining services from Brink's without a formal written agreement. TPA has continued to operate under the same agreement terms as defined in the executed agreement from 2014 and subsequent amendments. The proposed amendment to the previously authorized agreement with Brink's is to address the outstanding concerns arising from this two-year period. This report seeks approval from TPA Board of Directors to negotiate, execute, and sign an additional one (1)-year agreement with Brink's for coin and note processing to provide sufficient time to consider procurement options and scope of services which will address changing consumer payment preferences and recent COVID-19 impacts, without suffering adverse operational impacts.

Authorized the President, Toronto Parking Authority, to negotiate, enter into, and execute, on behalf of Toronto Parking Authority, an amendment to the Brink's Canada Limited contract dated April 30, 2014, as amended by the first amendment dated June 3, 2016 and the second amendment dated December 1, 2016, to extend the expiry of this agreement to April 30, 2020, in accordance with the terms and conditions as generally outlined in Attachment 1 to the report (July 20, 2020) from the Acting President, Toronto Parking Authority, and on such other or amended terms and conditions as may be acceptable to the President, Toronto Parking Authority, and in a form satisfactory to the City Solicitor. 2. Authorized the President, Toronto Parking Authority, to negotiate, enter into, and execute, on behalf of Toronto Parking Authority, a one-year agreement with Brink's Canada Limited, in accordance with the terms and conditions as generally outlined in Attachment 5 to the report (July 20, 2020) from the Acting President, Toronto Parking Authority, and on such other or amended terms and conditions as may be acceptable to the President, Toronto Parking Authority, and in a form satisfactory to the City Solicitor.

A tender package, including all technical requirements, material, and labour for the modifications to operations for Car Parks 26 (33 Queen Street East), 36 (110 Queen Street West), and 125 (323 Richmond Street East), was prepared by Our Cool Blue Architects. Our Cool Blue Architects tendered the work on behalf of TPA to eleven (11) pre-qualified general contractors on March 20, 2020. The call closed on May 8, 2020 and four (4) bids were received and considered as listed below in ascending order. Granted authority to award the construction contract for the modifications to operations for Municipal Car Parks 26 (33 Queen Street East), 36 (110 Queen Street West), and 125 (323 Richmond Street East) to Canada Construction Limited, having submitted the lowest compliant bid and meeting all specifications in conformance with the construction tender requirements, in the amount of $1,169,110 plus $117,000 as a contingency allowance, being the sum total amount of $1,286,110 net of all taxes and charges.

At its meeting on July 23, 2019, the Board discussed Municipal Car Park 673, 2204-2212 Eglinton Avenue West and requested that staff consult with the local Councillor, the Chief Executive Officer, CreateTO, and the Deputy City Manager, Corporate Services, on including the lands of Municipal Car Park 673, located at 2204-2212 Eglinton Avenue West, in the ongoing review of City-owned assets for the Housing Now Initiative and to report to the Board with an update. No substantive update has been provided as of yet.
