The purpose of this report is to receive Board approval to enter into an agreement with Toronto Hydro-Electric System Limited to pilot the deployment of thirty-two (32) Electric Vehicle chargers at Toronto Parking Authority operated parking facilities. This will be executed in two phases: The first phase will upgrade Toronto Parking Authority's nine (9) existing electric charging stations and convert them to Level Two (L2) smart chargers. The second phase will add an incremental twenty (20) L2 charging stations and three (3) L3 fast charging stations for a total of twenty-three (23) incremental Electrical Vehicle chargers. As North America's largest municipally-owned parking operator, Toronto Parking Authority has a unique opportunity to jump start the penetration of Electrical Vehicle chargers across its asset base in order to accelerate the electrification of both personal and commercial vehicles in support of the City of Toronto's Electrical Vehicle strategy and TransformTO vision. The Toronto Parking Authority currently lags its North American peers in Electrical Vehicle deployment, but will use this modest pilot as a learning tool to provide the insights and learnings to develop a more robust Electrical Vehicle strategy for 2022 and beyond. Concurrently, management will be engaging a number of government and commercial partners (i.e., Transportation Services, Fleet Services, Toronto Atmospheric Fund, Natural Resources Canada, Pembina, Transnational Corporations, Automotive etc.) in support of the development of this strategy.
The Board of Directors of Toronto Parking Authority: 1. Authorized the President, Toronto Parking Authority, to negotiate, enter into and execute on behalf of Toronto Parking Authority, two (2) three (3)-year agreements with Toronto Hydro-Electric System Limited to provide the necessary goods and services necessary for Toronto Hydro-Electric System Limited to operate specific electric vehicle charging infrastructure stations within parking facilities operated by Toronto Parking Authority, in accordance with the terms and conditions contained in Appendix B to the report (March 15, 2021) from the President, Toronto Parking Authority, and any such other or amended terms and conditions as may be acceptable to the President, Toronto Parking Authority, and in a form satisfactory to the City Solicitor. 2. Directed the President, Toronto Parking Authority, to: a. make information available through the City of Toronto's Open Data portal on the current status and location of Toronto Parking Authority Electric Vehicle charging facilities, including the number of chargers, usage data collected, and other relevant information, as part of the pilot and future installations; and b. consult with the General Manager, Transportation Services, to ensure the pilot is coordinated and aligned with the City of Toronto's Council-adopted Electric Vehicle Strategy. 3. Directed the President, Toronto Parking Authority, in consultation with the appropriate City Divisions and Agencies, including Environment and Energy Division, and CreateTO, to explore opportunities to expedite the analysis and installation of additional sites for Electric Vehicle charging equipment. 4. Directed the President, Toronto Parking Authority, in consultation with the appropriate City Divisions and Agencies, including Environment and Energy Division, Transportation Services, and Engineering and Construction Services, to explore opportunities to expand on-street charging infrastructure to support Electric Vehicle access for residents who do not have dedicated parking spaces and integrate charging infrastructure into major capital projects such as road reconstruction.

Expansion of Security Guard Services at Toronto Parking Authority Off-Street Parking Facilities
At its meeting of December 12, 2019 (Item PA11.6), the Board of Directors, Toronto Parking Authority, granted management the authority to award a two-year contract to Garda Canada for the security of its off-street parking facilities effective January 1, 2020 for a sum not to exceed $4,074,260 including contingencies. However, throughout the course of 2020 and Q1 2021, there has been an unprecedented increase in the number of reported acts of vandalism, drug use, fire alarms, biologic contamination, car damage and customer/staff harassment across our facilities - particularly in the downtown core. These incidents have driven a marked increase in customer complaints over the past twelve (12) months; moreover, Toronto Parking Authority staff have expressed similar concerns to Management about the health and safety of their colleagues and facilities. In light of this current operating environment, exacerbated largely by the unexpected length of the pandemic and continued challenges of the homeless tragedy, management has been obligated to increase its spending on security by an unplanned $305,000 in 2020 and an incremental $795,000 in 2021 in order to ensure the health and safety of its staff, customer and facilities. These changes represent an increase of $1,100,000 to the current contract with Garda Canada, which in turn drives the request for a contract amendment requiring Board authorization.

2053 Dufferin Street - Municipal Car Park 670
Toronto Parking Authority operates a 23-space, surface car park at 2053 Dufferin Street known as Car Park 670. The car park is comprised of both lands owned by the City of Toronto, as well as, a 2.47 metre (m) wide strip of the northern portion of 2045 Dufferin Street (Private Premises). The Private Premises was operated under a Parking Management Agreement with the owner of the Private Premises, Dufferin Street Professional Clinic Inc. (Owner), authorized by Toronto Parking Authority Board of Directors in 2007. As part of its ongoing review of underperforming locations, Toronto Parking Authority has identified Car Park 670 as a candidate location for disposal. Demands for parking at this location have been consistently low for a number of years and Toronto Parking Authority has realized net losses in each of the 14 years prior. Toronto Parking Authority has evaluated a range of options to improve the financial performance of Car Park 670, but has concluded that the operating expenses incurred at Car Park 670 will continue to exceed the revenues generated for the foreseeable future, regardless of the structure of the arrangement. A detailed analysis of the operations at Car Park 670 and the various options considered by Toronto Parking Authority to improve financial performance is provided herein. Given the low demand for parking, the continued financial losses and the availability at other Toronto Parking Authority lots operating nearby, Toronto Parking Authority is recommending that Toronto Parking Authority Board of Directors declare the property at 2053 Dufferin Street surplus to the operational needs of Toronto Parking Authority and refer the property to Corporate Real Estate Management to make available for other City Divisions, Agencies and Corporations. Should there be no interest in the property expressed by other City Divisions, Agencies and Corporations, the property would be made available for purchase on the open market. In addition, this report addresses the status of the Private Premises that are being used by Toronto Parking Authority for the expanded operation at Car Park 670. Toronto Parking Authority's use of these lands was the subject of a parking management agreement that expired in 2017. While the terms and conditions of the parking management agreement have continued to be honoured since the expiry of the agreement, authority is being requested to formally acknowledge the arrangement with the owner of the Private Premises and resolve all outstanding issues at 2053 Dufferin including the payment of all fee arrears and capital work needed to restore the Private Premises to their original condition.
The Board of Directors of Toronto Parking Authority: 1. Directed that Confidential Attachment 1 to the report (February 4, 2021) from the President, Toronto Parking Authority remain confidential in its entirety, at the discretion of the City Solicitor, as it pertains to financial information that belongs to the Board of Directors of Toronto Parking Authority and has monetary value or potential monetary value. 2. Declared the property located at 2053 Dufferin Street as surplus to the operational requirements of Toronto Parking Authority. 3. Directed Toronto Parking Authority to notify Corporate Real Estate Management that the property is surplus to the operational requirements of Toronto Parking Authority and to request Corporate Real Estate Management to make the property located at 2053 Dufferin Street available to City Divisions, Agencies and Corporations, and that should there be no interest, that the property be disposed in keeping with the standard approach to disposition of lands. 4. Authorized the President, Toronto Parking Authority to negotiate, enter into and execute an Agreement with the Owner to resolve all outstanding issues at 2045 Dufferin Street, including the payment of all arrears, and further management fees for a period not exceeding 18 months from April 6, 2021 and capital work needed to restore the Private Premises to their original condition. 5. Directed Toronto Parking Authority to terminate all operations at Car Park 670 as soon as practical and requested Corporate Real Estate Management to apply a Municipal Capital Facility designation to the site. 6. Requested City Council to remove Car Park 670 located at 2053 Dufferin Street from the list of municipal parking facilities identified in Chapter 950 of the Toronto Municipal Code.

This report seeks Toronto Parking Authority Board of Directors approval to enter into a one-year term parking management agreement (the Agreement) to provide parking management services for a 123-space surface parking lot located at 115 Unwin Avenue (the Property), known as Car Park 243, with CreateTO (on behalf of the City of Toronto Economic Development Corporation, operating as Toronto Port Lands Company (the Owner). The Agreement will continue Toronto Parking Authority's management of Car Park 243, which originally started in 2010, and has previously been continued through a series of one and two-year term agreements. While the overall financial value of the agreements has been low, Toronto Parking Authority's provision of parking management services represents an important community benefit in the Port Lands. The proposed Agreement with the Owner will be in accordance with the terms and conditions outlined in Confidential Attachment 1.

Parking Management Agreement - 689 King Street West and 180 Spadina Avenue
This report seeks the approval of Toronto Parking Authority Board of Directors to enter into and execute two (2) separate parking management agreements with Manga Hotels (King) Inc. (the Owner) in order to manage two (2) parking facilities (collectively the Subject Properties), located at 689 King Street West (Subject Property 1) and 180 Spadina Avenue (Subject Property 2), for a term of three (3) years, in accordance with the terms and conditions outlined in Confidential Attachment 1. The Subject Properties are both located in high demand areas where Toronto Parking Authority's rate setting strategy can be used to encourage short-term parking that will support local business. Both of the Subject Properties are being operated by third-party parking management operators as commercial parking facilities and will require minimal capital improvements to meet Toronto Parking Authority design requirements. Toronto Parking Authority was approached about the opportunity to operate the Subject Properties based on the full range of parking management services that Toronto Parking Authority offers, as well as, the strength of the Green P brand, in general. This opportunity will allow Toronto Parking Authority to capture the demand for parking in two (2) key locations in the downtown core and further improve its competitive position in the marketplace.

Toronto Parking Authority retained Our Cool Blue Architects Inc. to provide engineering design and contract administration services needed to make modifications to operations at Car Park 26 (Queen/Victoria Garage), Car Park 36 (Nathan Phillips Square Garage) and Car Park 125 (Richmond/Sherbourne Garage). Planned improvements include the replacement of in-lane attendant booths with customer service booths, traffic flow adjustments, installation of pay on foot machines and relocating payment equipment. The total contract amount approved in 2019 for these modifications was $70,000, excluding Harmonized Sales Tax. Following the award of the contract, the scope of work for the design was updated to reflect new information technology and operational requirements. Our Cool Blue Architects Inc. also identified additional time and effort to complete the design work during the COVID-19 pandemic, which has imposed restrictions on the work place and efficiency of work carried out. The construction contract for the modifications to Car Parks 26, 36, and 125 was awarded on August 25, 2020 to Canada Construction Limited in the amount of $1,286,110, excluding Harmonized Sales Tax. Work at these car parks commenced on January 4, 2021. As part of the scope of work at Car Park 36, a designated substance survey was carried out within the work zone in March of 2021. Investigations and testing have confirmed that asbestos and lead paint are present in multiple rooms within the car park. In addition, mercury was discovered in several overhead fluorescent lighting fixtures. Although the asbestos and mercury are undisturbed and presently in a safe condition, the materials will have to be removed as part of the modifications being undertaken at Car Park 36. The condition of the lead paint will be reviewed in more detail and is subject to further recommendations from Our Cool Blue Architects Inc. To address the change in scope and schedule, Toronto Parking Authority staff are recommending that Toronto Parking Authority Board of Directors authorize an increase in value of the original contract (Purchase Order Number 38191) with Our Cool Blue Architects Inc. A future report to Toronto Parking Authority Board of Directors will address the change in scope for the Canada Construction Limited contract.

Temporary Parking Arrangements - 31 Langford Avenue (Car Park 142)
As part of its Easier Access and Second Exit Programs, Toronto Transit Commission will be modernizing its Donlands Subway Station (Donlands Station), located at the southwest corner of Donlands Avenue and Strathmore Boulevard. The project includes the construction of two elevators, as well as, a second entrance / exit to the station at Dewhurst Boulevard south of Strathmore Boulevard (Project). As part of the Project, Toronto Transit Commission has identified a construction staging area on Strathmore Boulevard, which will obstruct access to eighteen (18) on-street residential permit parking spaces and a further four (4) spaces located on private driveways for a three (3) year period. At its meeting of February 24, 2021 (Item TE23.62) Toronto and East York Community Council approved the construction staging area for the Project and directed Toronto Transit Commission to make arrangements with Toronto Parking Authority to accommodate the parking displaced by the construction staging area within Toronto Parking Authority's car parks at Langford Avenue or Woodycrest Avenue. Toronto Parking Authority has carried out a review of its operations in the area and has determined that the most efficient arrangement would involve the accommodation of the displaced parking at the 27-space location at 31 Langford Avenue, also known as Car Park 142. To facilitate this arrangement, it is proposed that Toronto Transit Commission enter into an agreement with Toronto Parking Authority or the exclusive use of the 27-space lot at 31 Langford Avenue (Rented Area) (refer to Attachment 1 - Site Location Map), for a term of three (3) years, with the option to extend the term for one (1) year (Construction Period). Authority from the Board of Directors of Toronto Parking Authority is required to negotiate, enter into and execute a Memorandum of Understanding with Transit Commission, or other form of agreement as may be acceptable to the City Solicitor, to permit the temporary use of Car Park 142 by area residents impacted by Transit Commission's construction staging area.

Authorized the President, Toronto Parking Authority to negotiate, enter into and execute a Memorandum of Understanding or other form of agreement with the Toronto Transit Commission, as may be acceptable to the City Solicitor, to accommodate the loss of parking spaces due to Toronto Transit Commission's construction at Donlands Subway Station at 31 Langford Boulevard (Car Park 142) in accordance with the Terms and Conditions outlined in the report (March19, 2021) from the President, Toronto Parking Authority, and any such other amended terms and conditions as may be acceptable to the President, Toronto Parking Authority and the City Solicitor.

Toronto Parking Authority Policy Resolution 5-10: Delegation of Authority (see Appendix A) sets out the authorities delegated by the Board of Directors of Toronto Parking Authority to Toronto Parking Authority to make financial commitments and execute documents. Toronto Parking Authority is proposing to amend the policy to update the cost thresholds, explicitly recognize the authorities related to parking management agreements, real estate activities involving lands or a portion of lands under Toronto Parking Authority's operational jurisdiction and the lack of Toronto Parking Authority's authority to acquire lands or an interest in lands. Further amendments are proposed to clarify the authority to amend or extend contracts and the authorities provided to Toronto Parking Authority to execute documents that bind the corporation. The proposed amendments will provide Toronto Parking Authority with increased operational flexibility, ensure alignment with the authorities provided to Toronto Parking Authority under Chapter 179 of the Municipal Code and minimize the potential for misinterpretation. Consequential amendments to Policy 5-13 - Purchase Cards (National Bank Mastercard) are needed to ensure alignment with the proposed changes to Policy 5-10. In summary, the recommended amendments to Policy 5-10: Delegation of Authority - Increase the President's commitment authority from $250,000 to $500,000; - provide greater clarity for staff; - request delegated authority for the President and Departmental Vice Presidents with regards to Parking Management Agreements with up to $250,000 net operating income; and - include the authority restrictions defined under Chapter 179 of the Municipal Code. No other changes to delegation authorities are proposed in this report.

This is a report on the status of the legal action commenced by Toronto Parking Authority on January 17, 2019 against BSaR (Eglinton) Ltd. and BSaR (Eglinton) LP (both together referred to as BSaR), and BSaR's principals, Tarek Sobhi, and Tyler Hershberg. Improving Toronto’s Bike Share Program
This report responds to City Council's request to the Toronto Parking Authority Board of Directors to direct the Acting President, Toronto Parking Authority to report back to the City of Toronto Infrastructure and Environment Committee by the end of fourth quarter 2020, to report on: the feasibility of increasing the overcharge threshold; exploring low-cost options; and a strategic plan to align with ActiveTO bike lanes.
