(collectively described as the "Applicant") have applied for five variances, each to subject to two conditions, required to allow the Chief Building Official ("CBO") to issue a sign permit to erect and display a double-faced third party electronic ground sign, displaying electronic static copy (the "Proposed Sign"), on the property municipally known as 746 Warden Avenue (the "Subject Premises"). The Subject Premises is designated as an Employment ("E") Sign District, which allows third party electronic ground signs. The Proposed Sign would have a maximum height of 2.65 metres, and would contain two rectangular sign faces, each with a maximum 0.93 metres horizontal dimension by 1.65 metres vertical dimension, with a maximum sign face area of 1.54 square metres. The Proposed Sign is described further in Attachment 1. The requirements in Chapter 694 which have been requested to be varied, and the proposed varied requirements are summarized below: 1) Existing requirement § 694-14R: No sign shall be located in a visibility zone. Proposed Varied Requirement: To allow the Proposed Sign to be erected in a visibility zone. 2) Existing requirement § 694-25C(2)(d): An E - Employment Sign District may contain a third-party electronic ground sign, provided the sign shall not be erected within any required setback of a building from a street as regulated by the City's applicable Zoning By-law. Proposed Varied Requirement: To allow the Proposed Sign to be erected 0.5 metres from the property line, whereas the minimum Zoning By-law required setback is 9.0 metres. 3) Existing requirement § 694-25C(2)(e): An E - Employment Sign District may contain a third-party electronic ground sign, provided the sign shall not be erected within 60 metres of any premises located, in whole or in part, in an R, RA, CR, I or OS sign district. Proposed Varied Requirement: To allow the Proposed Sign to be erected approximately 31.0 metres of a premises located in a R sign district. 4) Existing Requirement § 694-25C(2)(f): An E - Employment Sign District may contain a third-party electronic ground sign, provided where a sign is located within 250 metres of an R, RA, CR, I or OS sign district, the sign cannot face any premise in the R, RA, CR, I or OS sign district. Proposed Varied Requirement: To allow the Proposed Sign to be facing premises in the R sign district and the OS sign district located, respectively, 31 and 220 metres to the east. 5) Existing Requirement § 694-25.C(2)(h): An E - Employment Sign District may contain a third party electronic ground sign, provided there shall be no more than one ground sign or electronic ground sign erected on the premises. Proposed Varied Requirement: To allow the Proposed Sign to be an additional sign erected on a premises containing one first party ground sign. Each of the requested variances, if granted, would be subject to the following conditions: Condition 1: The sign faces of the Proposed Sign shall each have a sign face area not exceeding 1.54 square metres. Condition 2: The height of the Proposed Sign shall not exceed of 2.65 metres. Following a review of the Applicant's submissions and additional information provided by the staff, the CBO has determined that there is not a sufficient basis to conclude that the eight required criteria in §694-30A of the Sign By-law have been established with respect to the five variances, each subject to the noted conditions, as described further in Attachment 1 of this report.
The Sign Variance Committee: 1. The BADER GROUP Inc., Jolt Charge Inc., and George Gagne (collectively described as the "Applicant") have applied for seven variances, each subject to two conditions condition, required to allow the Chief Building Official ("CBO") to issue a sign permit to erect and display a double-faced third party electronic ground sign, displaying electronic static copy (the "Proposed Sign"), on the premises municipally known as 1139-1141 Kennedy Road (the "Subject Premises"). The Subject Premises is designated as an Employment ("E") Sign District, which allows third party electronic ground signs. The Proposed Sign would have a maximum height of 2.65 metres, and would contain two rectangular sign faces, each with a maximum horizontal dimension of 0.93 metres and maximum vertical dimension of 1.65 metres, with a maximum sign face area of 1.54 square metres. The Proposed Sign is described further in Attachment 1. The requirements in Chapter 694 which have been requested to be varied, and the proposed varied requirements are summarized below: 1) Existing requirement § 694-14R: No sign shall be located in a visibility zone. Proposed Varied Requirement: To allow the Proposed Sign to be erected in a visibility zone. 2) Existing requirement § 694-22D: A third party sign shall not be erected within 100.0 metres of any other lawful third party sign whether or not erected. Proposed Varied Requirement: To allow the Proposed Sign to be erected approximately 89 metres from other lawful third party sign located at 1149 Kennedy Road. 3) Existing requirement § 694-22E: A third party electronic sign, as permitted by Subsections 694-25A(2), C(2), D(3), D(4), 694-26I(1), (2) and (3) shall not be erected within 150.0 metres of any other lawful third party sign whether or not erected. Proposed Varied Requirement: To allow the Proposed Sign to be erected approximately 89 metres from other lawful third party sign located at 1149 Kennedy Road. 4) Existing requirement § 694-25C(2)(d): An E - Employment Sign District may contain a third-party electronic ground sign, provided the sign shall not be erected within any required setback of a building from a street as regulated by the City's applicable Zoning By-law. Proposed Varied Requirement: To allow the Proposed Sign to be erected 0.5 metres from the property line, whereas the minimum Zoning By-law required setback is 3.0 metres. 5) Existing requirement § 694-25C(2)(e): An E - Employment Sign District may contain a third-party electronic ground sign, provided the sign shall not be erected within 60 metres of any premises located, in whole or in part, in an R, RA, CR, I or OS sign district. Proposed Varied Requirement: To allow the Proposed Sign to be erected approximately 31.0 metres of a premises located in a CR sign district and 40 metres of a premises in a R sign district. 6) Existing Requirement § 694-25C(2)(f): An E - Employment Sign District may contain a third-party electronic ground sign, provided where a sign is located within 250 metres of an R, RA, CR, I or OS sign district, the sign cannot face any premise in the R, RA, CR, I or OS sign district. Proposed Varied Requirement: To allow the Proposed Sign to be facing premises in the CR sign district approximately 31 metres to the west, in the R sign districts 40 metres to the northwest and 70 metres to the west, and in the I sign district approximately 245 metres to the south. 7) Existing Requirement § 694-25.C(2)(h): An E - Employment Sign District may contain a third party electronic ground sign, provided there shall be no more than one ground sign or electronic ground sign erected on the premises. Proposed Varied Requirement: To allow the Proposed Sign to be an additional sign erected on a premises containing one first party ground sign. Each of the requested variances, if granted, would be subject to the following condition: Condition 1: The sign faces of the Proposed Sign shall each have a sign face area not exceeding 1.54 square metres. An application for four variances, each subject to six conditions, as required to allow for a permit to be issued to erect and display a double-faced third party electronic ground sign, displaying electronic static copy (the "Proposed Sign") on the premises municipally known as 130 Rexdale Boulevard, in Etobicoke (the "Subject Premises"). TARGET Outdoor Canada (the "Applicant") represents that this application is authorized by the owner of the Subject Premises. The Subject Premises is designated as an Employment ("E") Sign District, which allows third party electronic ground signs. The Proposed Sign will contain no more than two rectangular sign faces, in a "V-shape" configuration, each face with a horizontal measurement not exceeding 8.8 metres (centre line) and a vertical measurement not exceeding 2.3 metres (bisecting line), with a maximum height of 10.0 metres. The Proposed Sign is described further in Attachment 1. The Proposed Sign requires four variances to Chapter 694 to allow the Chief Building Official ("CBO") to issue the sign permit. The requirements in Chapter 694 which have been requested to be varied, and the proposed varied requirements are summarized below: 1) § 694-25.C(2)(e) - An Employment "E" Sign District may contain a third party electronic ground sign, provided the sign shall not be erected within 60.0 metres of any premises located, in whole or in part, in an R, RA, CR, I or OS sign district. Proposed New Requirement: The Proposed Sign would be located within approximately 40 metres of a CR sign district. 2) § 694-25.C(2)(f) - An Employment "E" Sign District may contain a third party electronic ground sign, provided where a sign is located within 250 metres of an R, RA, CR, I or OS sign district, the sign cannot face any premise in the R, RA, CR, I or OS sign district. Proposed New Requirement: The Proposed Sign would be located approximately 40 metres of a CR sign district to the east, 150 metres and 215 metres of RA sign districts to the northeast, 158 metres and of an R sign district to the northeast and 180 metres of an OS sign district also to the northeast, and would face all of the aforementioned sign districts. 3) § 694-25.C(2)(h) - An Employment "E" Sign District may contain a third party electronic ground sign, provided there shall be no more than one ground sign or electronic ground sign erected on the premises. Proposed New Requirement: The Proposed Sign would be erected on a premises containing one first party ground sign. 4) § 694-25.C(2)(k) - An Employment "E" Sign District may contain a third party electronic ground sign, provided where the sign has two faces, the sign faces shall be back-to-back. Proposed New Requirement: The Proposed Sign would have the sign faces displayed in a "V-shape" configuration. The Applicant has proposed that the variances be granted subject to the following conditions: Condition 1: The sign shall operate with a maximum brightness of 150 NITS between sunset and sunrise; Condition 2: Light shielding technology shall be installed on the Proposed Sign; Condition 3: The Proposed Sign's sign faces shall each have a sign face area that shall not exceed 20.0 square metres. Condition 4: The existing first party sign on the south frontage (Rexdale Boulevard frontage), shall be removed and all associated permits be revoked, prior to the issuance of a sign permit for the Proposed Sign. Condition 5: Any and all existing third party signs located at 130 Rexdale Boulevard shall be removed and all associated permits be revoked prior to the issuance of the sign permit for the Proposed Sign. Condition 6: The interior angle of the Proposed Sign's sign faces not exceed 11 degrees, in such a manner so that the centre line of each sign face, if projected to the street line separating the premises from Rexdale Boulevard, would possess an internal angle with the street line separating the premises from Rexdale Boulevard of no less than 84 degrees and no greater than 90 degrees. Following a review of the Applicant's submissions and additional information obtained by the City of Toronto staff investigation, the CBO has determined that there is a sufficient basis to conclude that the eight required criteria in §694-30A of the Sign By-law have been established with respect to the variances, subject to the noted conditions, as described further in Attachment 1 to this report. As such, the CBO is of the opinion that Sign Variance Committee may grant the four requested variances, each subject to six conditions, required to allow for a permit to be issued to erect and display the "Proposed Sign") on the Subject Premises.

The Subject Premises is designated as an Employment ("E") Sign District, which allows third party electronic ground signs. Proposed New Requirement: To permit the Proposed Sign to be facing premises in an OS Sign District 3.0 metres to the southwest, an OS Sign District 140.0 metres to the east, and an R Sign District 241.0 metres to the east. 3) Existing Requirement § 694-25.C(2)(h): An E - Employment Sign District may contain a third party electronic ground sign, provided there shall be no more than one ground sign or electronic ground sign erected on the premises. Proposed New Requirement: To allow the Proposed Sign to be an additional sign erected on a premises which contains already one first party ground sign. 4) Existing Requirement § 694-25C(2)(k): An E - Employment Sign District may contain a third party electronic ground sign, provided where the sign has two faces, the sign faces shall be back to back. Proposed New Requirement: To permit the Proposed Sign to contain two sign faces in a "V-shape" configuration. Each of the requested variances, if granted, would be subject to all of the following conditions: Condition 1: The Proposed Sign have installed and maintained a physical barrier along the eastern edge of the southwestern sign face, which shall sufficiently block illumination from the sign to the satisfaction of the Chief Building Official. Condition 2: The interior angle of the sign faces shall not exceed 45 degrees. Condition 3: The height of the sign shall not exceed the lesser of 9.0 metres or the height of the existing buildings located on the Subject Premisses as of August 22, 2024. Condition 4: The Proposed Sign's sign faces shall be orientated in the approximately northerly and southwesterly directions. Condition 5: The sign shall operate with a reduced brightness of 150 NITS between sunset and sunrise. Following a review of the Applicant's submissions and additional information provided by the staff, the CBO has determined that there was sufficient information to conclude that the eight required criteria in §694-30A of the Sign By-law have been established with respect to the four variances, each subject to all of the noted conditions, as described further in Attachment 1 of this report.

Van Horne Outdoor LP (the "Applicant") has made an application for three variances required to allow the erection and display of one single-sided third party electronic ground sign displaying electronic static copy (the "Proposed Sign") to be located on the portion of a specific Utility Sign District ("U Sign District"), which is, immediately to the north of Sheppard Avenue West, and immediately east of the premises municipally known as 2300 Sheppard Avenue West (the "Proposed Location"). The Proposed Location is a portion of premises which currently function as a rail corridor that is commonly known as the MacTier Subdivision. This portion of the premises is designated as an U Sign District, which permits third party electronic ground signs. The Proposed Sign would have a height of 10 metres, and would contain one rectangular sign face, with a centre line of 6.10 metres and a bisecting line of 3.05 metres for a maximum a sign face area of 18.60 square metres. The Proposed Sign will be orientated so that the sign face faces west and shall be located in a specific location within the premises, and is described further in Attachment 1 to this report. The Proposed Sign would require three variances to Chapter 694, to allow the Chief Building Official ("CBO") to issue the sign permit. The requirements of Chapter 694 which have been requested to be varied, and the proposed varied requirements are summarized below: Existing Requirement 1: § 694-22E - A third party electronic sign shall not be erected within 150.0 metres of any other lawful third party sign whether or not erected. Proposed New Requirement: The Proposed Sign will be erected 140.00 metres from an existing third party sign located at 2256 Sheppard Avenue West. Existing Requirement 2: § 694-25D (3)(e) - A Utility Sign District may contain a third party electronic ground sign, provided the sign shall not be erected within 60.00 metres of any premises located, in whole or in part, in an R, RA, CR, I or OS Sign District. Proposed New Requirement: The Proposed Sign will be located within 35.0 metres to the North of a premises located in a CR Sign District. Existing Requirement 3: § 694-25D (3)(f) - A Utility Sign District may contain a third party electronic ground sign, provided where a sign is located within 250.00 metres of an R, RA, CR, I, or OS Sign District, the sign cannot face any premise in the R, RA, CR, I or OS Sign District. Proposed New Requirement: The Proposed Sign will be located within 180.00 metres of, and face, the R Sign District to the south of the Proposed Location; and will be located within 180.00 metres of, and face, the CR sign district located to the west of the Proposed Location. The Applicant has made an application seeking that each of the required variances would be subject to the following conditions: 1) The maximum brightness of the Proposed Sign not to exceed 150 NITS at dusk to 11:00 PM; and 2) The Proposed Sign's sign face be orientated facing westerly and in such a manner so that the centre line of the sign face, if projected to the street line separating the premises from Sheppard Avenue West, would possess an internal angle with the street line separating the premises from Sheppard Avenue West of no less than 105o and no greater than 115o; and, 3) The Proposed Sign be located within the Proposed Location that is substantially in accordance with the specific location within the Proposed Location indicated as the location of the Proposed Sign as noted in Diagram 1: Location of Proposed Sign, as attached as Appendix 1 to this report. After reviewing the Applicant's submissions and the additional information provided by City staff, the CBO determined that there is sufficient evidence to conclude that the eight required criteria in §694-30A of the Sign By-law have been established with respect to the three variances, subject to the three specific conditions as described further in Appendix 1 to this report.

The Sign Variance Committee grant the requested variances to sections 694-22E, 694-25D (3)(e) and 694-25D (3)(f), each subject to three conditions, as required to allow for the issuance of a permit respecting the erection and display of the Proposed Sign, as further described in Appendix 1 to this report.
