This report addresses an appeal of the decision of the Chief Building Official and Executive Director, Toronto Building ("CBO") concerning an application for a Signage Master Plan regulating a portion of the premises municipally known as 2075 Bayview Avenue ("2075-Bayview") consisting of the majority of the northern elevation of a the building known as "S-Wing" (the "Specific Location") concerning three variances sought for three first party illuminated wall signs displaying static copy (the "Proposed Signage Master Plan") . Two of the wall signs in the Proposed Signage Master Plan ("Proposed Sign 1" and "Proposed Sign 2") would have been located on the fifth storey, and the other ("Proposed Sign 3") would have been located on the sixth storey of the northerly elevation of the S-Wing building at 2075-Bayview. Sunnybrook Health Sciences Centre as represented by Permit World (the "Applicant") applied for the Proposed Signage Master Plan, as described in Attachment 1. The Applicant indicated the three signs contained in the Proposed Signage Master Plan were intended offer identification and wayfinding to guests and patients on the hospital campus. Notice of the application for the Proposed Signage Master Plan was provided to the public, and the CBO conducted a written hearing in accordance with the requirements of the Sign By-law. Various parties participated in the hearing and filed materials in relation thereto. Upon receipt of the materials provided, the CBO made the decision to deny the application for the Proposed Signage Master Plan; at this same time, the CBO also made the decision to approve a substantively different Signage Master Plan, which while addressing the same location, and similar signs, contained specific conditions regarding illumination (the "CBO-Designed Signage Master Plan"). Specially the CBO-Designed Signage Master Plan, imposed conditions on the signs, that if illuminated, the sign shall not be illuminated between the hours of 11:00 p.m. and 7:00 a.m., and that illumination shall not exceed 150 nits during the period between sunset and sunrise for the signs. The CBO determined that the Proposed Signage Master Plan, would not meet all nine criteria, however, the CBO, determined based on the materials presented by the Applicant and others, that a Signage Master Plan which contained conditions on the illumination of the signs in the Specific Location, would be able to meet the nine criteria as these conditions would be sufficient to mitigate the potential for adverse impacts on surrounding properties, and other criteria. After the issuance of the CBO's decision denying the variances requested for the Proposed Signage Master Plan, and granting the variances, subject to conditions, required for the CBO-Designed Signage Master Plan, one of the parties to the hearing, Eda Di Pierdomenico (the "Appellant") filed an appeal of the CBO's decision. As a result of the Appellant filing an appeal of the CBO's decision, Sign Variance Committee ("SVC") is now conducting an appeal de novo, meaning that the SVC are required to conduct an evaluation to determine whether the Applicant has demonstrated that the Proposed Signage Master Plan meets all nine criteria, on the basis of the information presented to the Sign Variance Committee. The SVC may make a decision to refuse, or grant the variances requested by the Applicant for the Proposed Signage Master Plan, or to make a decision to grant different variances, or impose conditions which the Applicant did not include in the Proposed Signage Master Plan. It is the CBO's opinion that it has not been established that the Proposed Signage Master Plan would meet all nine established criteria as contained at §694-30A of the Sign By-law, but that the CBO-Designed Signage Master Plan as set out in Attachment 2 would meet all of the required criteria.
The Sign Variance Committee: 1. Approved the three variances to 694-21F (4)(a), each subject to one condition required for the implementation of the Signage Master Plan consisting of three (3) non-illuminated wall signs located above the first storey of the northern elevation of the S-Wing of the Premises municipally known as 2075 Bayview Avenue, as described further below: Signage Master Plan Description: The Signage Master Plan shall address the following specific location: the portion of the northern elevation of a building, with the exception of the first story, informally referred to the "S-Wing" located on premises municipally known as 2075 Bayview Avenue, and shall contain only the three signs as described further below, each requiring the variances, each subject to the one condition, as listed below: a. Sign 1 - Description: One first party wall sign to be located on the fifth storey of the north elevation of S-Wing, located on the premises municipally known as 2075 Bayview Avenue, in accordance with the diagram labelled as Figure 1 in Attachment 1 of the January 15, 2024 Report of the Manager, Citywide Priorities, Toronto Building; and, further being in accordance with the following requirements: - One sign face; - Displaying static copy; - Having a horizontal measurement of 1.35 metres; - Having a vertical measurement of 24.40 metres; - At a height not to exceed 23.00 metres; - Shall not be illuminated; and - Oriented in a northerly direction. Required Variance 1, with respect to Sign 1: The requirement of § 694-21 F (4) (a), that: An I-Institutional sign district may contain a wall sign provided the sign shall only be erected at the first storey, be varied to allow Proposed Sign 1 to be located above the first storey, specifically at the fifth storey, subject to the one condition listed below: Condition with respect to Sign 1: 1. Notwithstanding any provision Municipal Code Chapter 694, Proposed Sign 1 shall not be illuminated at any time, or in any manner. b. Sign 2 - Description: One first party wall sign to be located on the fifth storey of the north elevation of S-Wing, located on the premises municipally known as 2075 Bayview Avenue, in accordance with the diagram presented below and labelled as Figure 2 in Attachment 1 of the January 15, 2024 Report of the Manager, Citywide Priorities, Toronto Building; and, further being in accordance with the following requirements: - One sign face; - Displaying static copy; - Having a horizontal measurement of 1.35 metres; - Having a vertical measurement of 20.80 metres; - At a height not to exceed 23.00 metres; - Shall not be illuminated; and - Oriented in a northerly direction. Required Variance 2, with respect to Sign 2: The requirement of § 694-21 F (4) (a), that: An I-Institutional sign district may contain a wall sign provided the sign shall only be erected at the first storey, be varied to allow Proposed Sign 2 to be located above the first storey, specifically at the fifth storey, subject to the one condition listed below: Condition with respect to Sign 2: 1. The Chief Building Official and Executive Director, Toronto Building, recommends that: 1. The Sign Variance Committee refuse the three requested variances to 694-21F (4)(a) required for the implementation of the Proposed Signage Master Plan consisting of three (3) wall signs located above the first storey of the northern elevation of the S-Wing of the Premises municipally known as 2075 Bayview Avenue, as described further in Attachment 1 of this report. 2. The Sign Variance Committee approve the three variances to 694-21F (4)(a), each subject to subject to two conditions required for the implementation of the CBO-Designed Signage Master Plan consisting of three (3) wall signs located above the first storey of the northern elevation of the S-Wing of the Premises municipally known as 2075 Bayview Avenue, as described further in Attachment 2 of this report.

This report addresses an appeal concerning one variance sought respecting a Signage Master Plan proposal (the "Proposed Signage Master Plan"). The Proposed Signage Master Plan addresses a defined area consisting of only a northeast portion of the roof of the building (commonly known as the Eaton Centre) on the premises, municipally known as 33 Dundas Street West (the "Subject Premises"). The Proposed Signage Master Plan contains one first party illuminated roof sign displaying static copy (the "Proposed Roof Sign"). The Proposed Roof Sign would have one sign face, displaying static copy, and would be identifying the Bank of Montreal ("BMO") on the Subject Premises. A Signage Master Plan was originally applied for by Zip Signs (the "Applicant") on behalf of Cadillac Fairview (the "Owner"). After conducting a review in accordance with the requirements of the Sign By-law, the Chief Building Official and Executive Director, Toronto Building ("CBO") made a decision to refuse to grant the requested variance on the basis that the Proposed Signage Master Plan did not meet all nine of the mandatory criteria. Specifically, the CBO determined that the Applicant failed to establish that the Proposed Roof Sign described would be compatible with the development of the premises and surrounding area, would not alter the character of the premises or surrounding area and would not be contrary to the public interest. Subsequently, the Applicant filed an appeal of the decision of the CBO. For the reasons listed above, the CBO, is of the opinion that the Sign Variance Committee should not grant the variance sought by the Applicant, to allow for the Proposed Roof Sign of the Proposed Signage Master Plan.
The Sign Variance Committee: 1. Granted the requested and required variance to Subsection 3.J.(2)(c), of Schedule C, Additional Special Sign District Regulations, of Chapter 694, Signs, General and the not requested but otherwise required variance to Subsection 3.J.(2)(g), of Schedule C, Additional Special Sign District Regulations, of Chapter 694, Signs, General for the implementation of the Signage Master Plan with respect to a defined area consisting of only the northeast portion of the roof of the building (commonly known as the Eaton Centre) on the premises, municipally known as 33 Dundas Street West (the "Subject Premises") and listed as 1 Dundas Street West in the applicable subsections of Schedule C, of Chapter 694, and consisting of one roof sign (the "Proposed Roof Sign"), as described in detail in Attachment 1 of the report (February 15, 2024) from the Manager, City Wide Priorities, Toronto Building.

The Sign Variance Committee refuse to grant the requested and required variance to Subsection 3.J.(2)(c), of Schedule C, Additional Special Sign District Regulations, of Chapter 694, Signs, General and the not requested but otherwise required variance to Subsection 3.J.(2)(g), of Schedule C, Additional Special Sign District Regulations, of Chapter 694, Signs, General for the implementation of the Signage Master Plan with respect to a defined area consisting of only the northeast portion of the roof of the building (commonly known as the Eaton Centre) on the premises, municipally known as 33 Dundas Street West (the "Subject Premises") and listed as 1 Dundas Street West in the applicable subsections of Schedule C, of Chapter 694, and consisting of one roof sign (the "Proposed Roof Sign") , as described in detail in Attachment 1 of this report.
