This report recommends approval of the Rental Housing Demolition application to demolish a two-and-a-half storey rental apartment building comprised of eight rental dwelling units at 3291 Kingston Road. The units will be replaced with eight new rental dwelling units as part of the approved redevelopment of the site consisting of a 12-storey residential building with 357 dwelling units in addition to the replacement units. Two of the eight rental units at 3291 Kingston Road were previously demolished without permits and are recommended to be included in the Rental Housing Demolition permit and replaced as part of the application. The proposal also includes the provision of a Tenant Relocation and Assistance Plan for all eligible tenants of the existing rental dwelling units, including the right to return to a replacement rental dwelling unit. The proposal also includes the demolition of two owner-occupied, single-detached houses at 2 and 4 Windy Ridge Drive. The properties are also the subject of an Official Plan Amendment and Zoning By-law Amendment application (20 209863 ESC 20 OZ) which was appealed by the owner to the Ontario Land Tribunal (OLT) in August 2022 due to a lack of decision from City Council. The Ontario Land Tribunal issued a written decision on November 10, 2023, approving the proposed Official Plan amendment and Zoning By-law Amendment in principle, with the final order being withheld until all outstanding matters, including the necessary agreements with the City, are secured, including considerations related to rental housing matters. This report recommends approval of the Residential Demolition Permit under Chapter 363 of the Toronto Municipal Code, subject to conditions.

The Director, Community Planning, Scarborough District recommends that: 1. City Council approve the Rental Housing Demolition application (20 209873 ESC 20 RH) in accordance with Chapter 667 of the Toronto Municipal Code and pursuant to Section 111 of the City of Toronto Act, 2006 to permit the demolition of eight (8) rental dwelling units at 3291 Kingston Road, subject to the following conditions: a. The owner shall provide and maintain eight (8) replacement rental dwelling units on the subject site for a period of at least 20 years beginning from the date that each replacement rental unit is first occupied and, during which time, no applications may be submitted to the City for condominium registration, or for any other conversion to a non-rental housing purpose, or for demolition without providing for replacement. The eight (8) replacement rental dwelling units shall collectively have a total gross floor area of at least 659 square metres and be comprised of one (1) one-bedroom, three (3) two-bedroom, and four (4) three-bedroom units, as generally illustrated in the plans submitted to the City Planning Division dated November 15, 2023. Any revision to these plans shall be to the satisfaction of the Interim Chief Planner and Executive director, City Planning Division; b. The owner shall, as part of the eight (8) replacement rental dwelling units required in Recommendation 1.a. above provide at least one (1) one-bedroom, three (3) two-bedroom, and four (4) three-bedroom units at affordable rents defined as gross monthly rent no greater than one times the average City of Toronto rent by unit type, as reported annually by the Canada Mortgage and Housing Corporation all for a period of at least ten (10) years beginning from the date of first occupancy of each unit. Rents shall not include additional charges for ensuite laundry or central air conditioning; c. The owner shall provide an acceptable Tenant Relocation and Assistance Plan to all Eligible Tenants of the existing rental dwelling units proposed to be demolished at 3291 Kingston Road, addressing the right to return to occupy one of the replacement rental dwelling units at similar rents, and other assistance to lessen hardship. The Tenant Relocation and Assistance Plan shall be developed in consultation with, and to the satisfaction of, the Interim Chief Planner and Executive Director, City Planning Division; d. The owner shall provide tenants of all eight (8) replacement rental dwelling units with access to, and use of, all indoor and outdoor amenities in the proposed development at no extra charge. Access to, and use of, these amenities shall be on the same terms and conditions as any other resident of the development, without the need to pre-book or pay a fee unless specifically required as a customary practice for private bookings; e. The owner shall provide ensuite laundry in each replacement rental dwelling unit within the proposed development; f. The owner shall provide at least one (1) one-bedroom replacement rental dwelling unit and four (4) three-bedroom replacement rental dwelling unit with balconies and three (3) two-bedroom rental replacement units with Juliet balconies for private and exclusive access by the tenants of such units; g. The owner shall provide central air conditioning in each replacement rental dwelling unit within the proposed development; h. The owner shall provide and make available at least eight (8) vehicle parking spaces to tenants of the replacement rental dwelling units. Such parking spaces shall be made available firstly to returning tenants who previously rented a vehicle parking space, and at similar monthly parking charges that such tenants previously paid. The remaining vehicle parking spaces shall be made available to tenants of the replacement rental units to the satisfaction of the Interim Chief Planner and Executive Director, City Planning Division; i. The owner shall provide tenants of the replacement rental dwelling units with access to bicycle and visitor vehicular parking on the same terms and conditions as any other resident of the proposed development; j. The eight (8) replacement rental dwelling units required in Recommendation 1.a above shall be made ready and available for occupancy no later than the date by which seventy percent (70%) of the new dwelling units in the proposed development, exclusive of the replacement rental dwelling units, are made available and ready for occupancy; and k. The owner shall enter into and register on title to the lands at 3291 Kinston Road, 2 and 4 Windy Ridge Drive an agreement pursuant to Section 111 of the City of Toronto Act, 2006 to secure the conditions outlined in Recommendations 1.a through 1.k above, all to the satisfaction of the City Solicitor and the Interim Chief Planner and Executive Director, City Planning Division. 2. City Council authorize the Interim Chief Planner and Executive Director, City Planning to issue Preliminary Approval of the Rental Housing Demolition Permit under Chapter 667 of the Toronto Municipal Code pursuant to Section 111 of the City of Toronto Act, 2006 for the demolition of the eight (8) rental dwelling units at 3291 Kingston Road after all the following have occurred: a. all conditions in Recommendation 1 above have been fully satisfied and secured; b. The Official Plan Amendment has come into full force and effect; c. the Zoning By-law Amendment has come into full force and effect; d. the issuance of the Notice of Approval Conditions for site plan approval by the Interim Chief Planner and Executive Director, City Planning or their designate pursuant to Section 114 of the City of Toronto Act, 2006; e. the issuance of excavation and shoring permits (conditional or full permits) for the approved development on the site; and f. the owner has confirmed, in writing, that all existing rental dwelling units proposed to be demolished are vacant. 3. City Council authorize the Chief Building Official and Executive Director, Toronto Building Division to issue a Rental Housing Demolition Permit under Chapter 667 of the Toronto Municipal Code after the Interim Chief Planner and Executive Director, City Planning Division has given Preliminary Approval referred to in Recommendation 2 above. 4. City Council authorize the Chief Building Official and Executive Director, Toronto Building Division to issue a Residential Demolition Permit under Section 33 of the Planning Act and Chapter 363 of the Toronto Municipal Code for 3291 Kingston Road and 2 and 4 Windy Ridge Drive after the Interim Chief Planner and Executive Director, City Planning Division has given Preliminary Approval referred to in Recommendation 2 above, which may be included in the Rental Housing Demolition Permit under Chapter 667 pursuant to section 6.2 of Chapter 363, on condition that: a. the owner removes all debris and rubble from the site immediately after demolition; b. the owner erects solid construction hoarding to the satisfaction of the Chief Building Official and Executive Director, Toronto Building Division; c. the owner erects the proposed building no later than four (4) years from the date on which the demolition of the existing rental dwelling units commences, subject to the timeframe being extended to the discretion of the Interim Chief Planner and Executive Director, City Planning Division; and d. should the owner fail to complete the proposed development containing eight (8) replacement rental dwelling units within the time specified in Recommendation 4.c. above, the City Clerk shall be entitled to enter on the collector's roll, as with municipal property taxes, an amount equal to the sum of twenty thousand dollars ($20,000.00) per dwelling unit for which a demolition permit is issued, and that such amount shall, until payment, be a lien or charge upon the land for which the Residential Demolition Permit is issued. 5. City Council authorize the appropriate City officials to take such actions as are necessary to implement City Council's decision, including execution of the Section 111 agreement and other related agreements.

This application proposes to amend the Official Plan and Zoning By-law to permit a residential infill development at 27 and 29 Parkcrest Drive. The proposed development consist of five blocks of stacked, back-to-back townhouse units. The proposed townhouse blocks are oriented along a shared private driveway from Parkcrest Drive and a central linear outdoor amenity space. Vehicular parking is provided in a one level underground parking garage. To facilitate the proposed development, the applicant requested an amendment to the Neighbourhoods designation of the Official Plan. Through the review of the application it was determined an Official Plan Amendment not required. Along this stretch of Kingston Road, townhouse built form occurs frequently as a transition between midrise development along the corridor and lower scale land uses within the Neighbourhoods. A zoning by-law amendment is still required in order to permit the proposed density on the lands and to establish appropriate performance standards to facilitate this development. The proposed development is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020). As noted above it conforms with the Official Plan and provides an additional housing opportunity that fits within the existing and planned context. This report reviews and recommends approval of the application to amend the Zoning By-law required to facilitate this development.

This application proposes to amend current Residential Detached Zone (RD) development standards under Toronto Zoning By-law 569-2013, as amended, for the lands 528 and 530 Birchmount Road, and 118 and 120 Newlands Avenue. The proposed rezoning would enable redevelopment of the four existing single detached residential properties with nine new single detached dwellings on smaller lots. The new lots are intended to be created through approval of a future consent application to sever the lands accordingly. The proposed development is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020). This report reviews and recommends approval of the application to amend the Zoning By-law. The proposal represents a modest residential intensification of lands currently designated Neighbourhoods under the Official Plan and will contribute to the City's housing stock while fitting into the existing and planned context.

3000, 3004, 3008, 3012 and 3020 Kennedy Road - Zoning Amendment - Decision Report - Approval
This application proposes to amend the Zoning By-law to permit the construction of 171 residential units within three-storey stacked and back-to-back townhouse buildings, with a total gross floor area (GFA) of approximately 17,950 square metres. The townhouse buildings are organized into nine blocks, with a total of 175 at grade vehicular parking spaces and 48 bicycle parking spaces at 3000, 3004, 3008, 3012 and 3020 Kennedy Road. The proposed development is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020). The proposed development also conforms to the City's Official Plan. This report reviews and recommends approval of the application to amend the Zoning By-law what will include a Holding provision (H). This Holding provision is to remain in place and restrict development on the site until such time as the owner, at its sole cost and expense, has resolved outstanding servicing and stormwater management issues. This report also makes note that a Draft Plan of Subdivision application has been submitted for the subject site, which pertains to create a new public east-west road connecting Fort Dearborn Drive to Kennedy Road. At this time, this report is only recommending approval of the Zoning By-law Amendment as the Draft Plan of Subdivision submission is still under review.

This application proposes to amend the Zoning By-law to permit the construction of a 4-storey apartment building at 4201 to 4203 Kingston Road and a portion of 120 Galloway Road at the southeast of the overall subject site. The building would contain 68 affordable rental housing units with a total gross floor area of 4847 square metres, resulting in a density of 0.96 times the area of the site. A total of 54 one-bedroom units and 14 two-bedroom units are proposed. The proposed infill development site includes 2,076 square metres of Toronto District School Board (TDSB) lands located on 120 Galloway Road which were added to the proposed site through an approved consent application to the Committee of Adjustment on May 1, 2024 (Application no. B0006/24SC). The proposed development would be supported by a total of 5 vehicular parking spaces, as well as 57 bicycle parking spaces. The proposed development is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020). The proposed development also conforms to the City's Official Plan. The proposed development responds to the City's affordable housing strategy and provides residential intensification on a site that benefits from frequent bus service in close proximity to the Guildwood GO Station. This report reviews and recommends approval of the application to amend the Zoning By-law.

1680 Brimley Road - Public Art Plan
The purpose of this staff report is to seek City Council approval of the 1680 Brimley Road - Public Art Plan ("The Plan"). The Plan, which is included as Attachment 1 of this report, outlines the method by which the owner will commission public art within a new Privately-Owned Public Space on the site. The Public Art Plan provides a framework and description of the commissioning of public art including: a project overview; project background; city consultation and community considerations; proposed location; selection process; mentorship program; amending procedure; communication and education strategy; budget and schedule. The attached Plan meets the objectives of the City's Percent for Public Art Guidelines and is supported by the Toronto Public Art Commission (TPAC).

25 Borough Drive, Scarborough- Public Art Plan
The purpose of this staff report is to seek City Council approval of the Public Art Plan ("The Plan") for 25 Borough Drive. The Plan, which is included as Attachment 1 of this report, outlines the method by which the owner will commission public art within the privately-owned publicly accessible space ("POPS") on the site. The Plan provides a framework and description of the commissioning of public art including: introduction; site overview; potential collaborators; community context, art consultant role; the section 37 agreement; public art approach; public art objectives; public art location; art selection strategy; jury composition; mentorship opportunities; proposed public art budget; and timeline. This staff report is about a matter for which Scarborough Community Council has delegated authority from City Council to make a final decision. In accordance with Section 33 of the Planning Act and City of Toronto Municipal Code Ch. 363, Article 6 "Demolition Control", the application for the demolition of the dwelling unit at 6482 Kingston Road is referred to the Scarborough Community Council to refuse or to grant the application as a building permit has not been issued for a replacement building. If the Scarborough Community Council grants issuance of the demolition permit, it may impose conditions if any, to be attached to the demolition permit.

114 Marcos Boulevard - Application to Remove a Private Tree
This report requests that Scarborough Community Council deny the request for a permit to remove one privately owned tree located at 114 Marcos Boulevard. The applicant indicates the reason for requesting removal of the tree is due to concerns over sewer back ups caused by tree roots and potential property damage and safety issues if the tree were to fail. The Colorado blue spruce tree (Picea pungens) measures 50 cm in diameter. The City's Tree By-laws do not support the removal of this tree as it is healthy and maintainable. The permit was denied, and the applicant is appealing the decision. Community Council has delegated authority from City Council to make a final decision as to whether a permit may be issued when an applicant wishes to appeal the denial of a permit of a tree protected under the By-laws.

The former owner of the lands municipally known as 25 Starfire Drive and 50 Scarboro Road was granted provisional consent to sever said lands in the matter of Application Number B066/10SC, to create five residential lots and to construct an extension of Starfire Drive, including all services and appurtenances thereto, so it connects with an existing section of Starfire Drive. A Consent Agreement between the City of Toronto and the former owner, registered on July 12, 2012 as Instrument AT3072020, secured the Starfire Drive extension construction obligations. As of this motion, the Starfire Drive extension has not been completed and the remaining work includes topcoat asphalt, top curb, sidewalks, right-of-way landscaping and repairs on the base curb and base asphalt. Authority from City Council is required to dedicate the Starfire Drive extension lands as public highway and to complete the remaining works for the Starfire Drive extension. The estimated cost to bring the Starfire Drive extension to a state of good repair is $600,000. Should the motion be adopted by City Council, Transportation Services' 2024-2033 Capital Budget and Plan will be increased by $94,000, which is an amount secured by the Consent Agreement in the form of a Letter of Credit provided by the former owner of the lands, and that amount will be expensed first to cover the costs of completing the outstanding works. The remaining funds for the Starfire Drive extension works will be temporarily accommodated from the Local Road Rehabilitation Program (CTP315-07) while City staff continue to pursue additional approaches to recovery in respect of the remaining costs for this work. Funding is available for this capital project categorized as a state of good repair in the 2024-2033 Capital Budget and Plan for Transportation Services.

Monitoring the Danforth Avenue Study - Victoria Park Avenue to Medford Avenue
At its meeting on January 29, 2008, City Council adopted the Danforth Avenue Study - Victoria Park Avenue to Medford Avenue - Official Plan, Zoning - Final Report (item SC12.25 ). This Avenue study put in place a growth framework that envisioned increased building heights and densities then what was previously permitted. Over 15 years have passed, and the planning vision has not completely materialized. The area remains under-invested in, and is in need of revitalization. City Planning staff are currently reviewing the Zoning for mid-rise buildings on Avenues across the City but are not proposing to apply any updates to completed Avenue Studies, including the Danforth Avenue Study in Scarborough Southwest. To maximize development potential and revitalize lands that have extremely good access to the Victoria Park subway station, my proposed motion requests Planning staff to consider applying the updated standards for new developments in and around the 2008 Danforth Avenue study lands. My intent is to help direct growth near to transit and reduce traffic congestion and reliance on the private automobile. My proposed motion does not re-open the Avenue study, but instead, requests Planning staff to consider applying new standards to the lands within and near the study area without making any changes. However, if changes are required, then my motion provides Planning staff the necessary direction to report to Scarborough Community Council. I hope that you can introduce my motion as part of the Supplementary agenda to the June 12, 2024 meeting of Scarborough Community Council.
