This application proposes to amend the Official Plan and Zoning By-law to permit the development of a 22-storey mixed-use building at 2993 to 3011 Sheppard Avenue East and 1800 to 1814 Pharmacy Avenue. The proposal contains 410 residential units along with commercial retail uses at grade along Sheppard Avenue East and Pharmacy Avenue. To facilitate the proposed development, an amendment to the Official Plan is proposed to redesignate the subject lands from Neighbourhoods to Mixed Use Areas and to establish a Site and Area Specific Policy to require that any future redevelopment contain a minimum of 1500 square metres of non-residential uses. A zoning by-law amendment is required in order to permit residential uses on the lands and to establish appropriate performance standards to facilitate this development. The proposed development is consistent with the Provincial Policy Statement (2020) and conforms with A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020). The development would intensify lands located on a priority transit corridor, providing an appropriate range and mix of uses on a currently underutilized site. The proposed built form transitions in scale to the adjacent low-scale land uses. It would include a base building of an appropriate height and scale to create a pedestrian street wall that will support and animate the public realm along these major streets. If approved, it will be a further addition to the reurbanization of this future higher order transit corridor. This report reviews and recommends approval of the application to amend the Official Plan and Zoning By-law required to facilitate this development.
The Scarborough Community Council recommends that: 1. 4630 Kingston Road - Zoning Amendment Application - Appeal Report
On December 29, 2021, a Zoning By-law Amendment application was submitted to permit the redevelopment of the subject lands with a 13-storey mixed-use building containing 417 residential units and 273.1 square metres of retail floor area. On August 23, 2022, the Applicant appealed the application to the Ontario Land Tribunal (the "OLT") due to City Council not making a decision within the time frame legislated by the Planning Act. City Planning Staff do not support the application in its current form as issues related to mix of uses have not been appropriately addressed. The applicant has also not satisfactorily demonstrated that the site can be serviced by available municipal infrastructure nor has it submitted an acceptable transportation impact statement. This report recommends that the City Solicitor, with the appropriate City staff, attend the OLT hearing to oppose the application in its current form. The report also recommends that staff be authorized to continue discussions with the Applicant to resolve outstanding issues.
The Scarborough Community Council recommends that: 1. City Council direct the City Solicitor and appropriate City staff to attend the Ontario Land Tribunal in opposition to the appeal of the Zoning By-law Amendment application in its current form for the lands at 4630 Kingston Road and to continue discussions with the applicant in an attempt to resolve outstanding issues. 2. In the event that the Ontario Land Tribunal allows the appeals in whole or in part, City Council authorize the City Solicitor to request the Tribunal that the issuance of any Final Order be withheld until such time as the City Solicitor advises that: a. the amending by-law is finalized, in a form and content acceptable to the City Solicitor and Chief Planner and Executive Director, City Planning, in a manner that implements the proposed development; b. the applicant has submitted a Traffic Impact Study and Transportation Demand Management Plan to the satisfaction of the General Manager, Transportation Services and Program Manager, District Transportation Planning Unit, Scarborough District; c. the applicant has addressed comments raised in the March 29, 2022 memorandum from the Toronto Transit Commission (TTC) to the satisfaction of the TTC; d. the applicant has submitted to the Chief Engineer and Executive Director, Engineering and Construction Services for review and acceptance, a Site Servicing Review to determine the storm water runoff, sanitary flow and water supply demand resulting from this development and demonstrate how this site can be serviced and whether the existing municipal infrastructure is adequate; and e. the applicant has entered into a financially secured Development Agreement for the construction of any improvements to the municipal infrastructure, should it be determined that upgrades are required to the infrastructure to support this development, according to the Site Servicing Review accepted by the Chief Engineer and Executive Director, Engineering and Construction Services; 3. City Council authorize the City Solicitor and City staff to take any necessary steps to implement City Council's decision.

5 Waltonice Road - Application for Fence Exemption
This staff report concerns a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application by the owner(s) of 5 WALTONICE RD to maintain a Wood fence with concrete retaining wall the rear yard on the south side of the property. This exceeds the maximum allowable height of a fence between two residential properties as stated in the Toronto Municipal Code, Chapter 4471.2B. (1) Table 1 - Maximum Height of Fences - Item 9 Any Fences.
The Scarborough Community Council: 1. Granted the exemption permit, to the owner(s) of 5 Waltonice Road, to allow them to maintain the Wood fence with concrete retaining wall with a height greater than 2 Metres. Directed and required that the existing fence be maintained in good repair without alteration. Directed and required that at such time as a replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, Fences or its successor by-law.

Pedestrian Crossing Protection - Mid-Block Beachell Street
This staff report is about a matter that Community Council has delegated authority from City Council to make a final decision. Transportation Services has reviewed the need for a pedestrian crossover (PXO), between Eglinton Avenue East and Luella Street/Conn Smythe Drive. Based on the assessment undertaken, Transportation Services does not recommend the installation of a mid-block PXO on Beachell Street as the warrant criteria was not met.

As the Toronto Transit Commission (TTC) operates a transit service on Orton Park Road, City Council approval of this report is required. Transportation Services has reviewed the need for pedestrian crossing protection on Orton Park Road and Botany Hill Road/Slan Avenue. Based on the assessment undertaken, Transportation Services recommends the installation of pedestrian crossing protection at Orton Park Road and Botany Hill Road/Slan Avenue. The proposed pedestrian crossover (PXO) will provide enhanced safety for vulnerable road users crossing at this intersection.

All-Way Stop Control - Denton Avenue and Robinson Avenue
For some time, residents have been contacting my office with right of way concerns at the intersection of Denton and Robinson, and recently there was an accident there. Having spoken in person with many in the area, I've found there is overwhelming support for implementation of an all way stop control at this location. I am requesting installation of an all way stop control at the intersection of Denton Ave. and Robinson Ave.

Parking Amendments - Adanac Drive
Residents of Adanac Drive advised my office of sightline issues on the curve just west of Bellamy Rd. S., when cars were parked on both sides. At my request, Transportation Services conducted a review and found that sightlines were limited and could be improved. Therefore, I am requesting a parking by-law amendment as per Transportation Services recommendation.

Port Union Road and Rozell Road Signalized Intersection
In response to resident requests for a signalized intersection at Rozell Road and Port Union Road to provide safe and accessible pedestrian and cyclist access to Adams Park, I am requesting that a traffic control signal be installed. As there is a major access point to Adam's Park located at the west end of Rozell Road. Presently, the nearest existing protected crossings to Rozell Road on Port Union Road, are approximately 440 meters to the north at Island Road and approximately 250 metres to the south at Lawson Road. Such distances have reportedly led pedestrians and cyclists to cross at the currently uncontrolled intersection of Rozell Road and Port Union Road or travel hundreds of metres away to access the nearest protected crossing. This Traffic Control Signal installation would align with the upcoming Port Union Road Improvement project.
