This staff report is in regards to a matter for which the North York Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application submitted by the owner of 21 Armour Blvd for a site-specific Fence Exemption to maintain an existing rear yard fence which does not comply with restrictions specified in the City of Toronto Municipal Code, Chapter 447, Fences. The subject property 21 Armour Blvd is located in Ward 16, on a residential zone property.

Municipal Licensing & Standards recommends that the North York Community Council give consideration to the exemption application and decide to: 1. Refuse to grant the application for an exemption permit by the owner(s) of 21 Armour Boulevard, for a 2.22m average high fence in the rear yard, for failing to comply with the provisions of Toronto Municipal Code, Chapter 447, Fences. Or, 2. Grant the application for the existing wood board on board fence, rear yard, between numbers 21 and 23 Armour Boulevard, measuring an average of 2.22m, without conditions.
