City Council amend Zoning By-law 438-86, for the lands at 1202 and 1204 Avenue Road substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 6 to the report (April 4, 2019) from the Director, Community Planning, North York District. 2. City Council amend City of Toronto Zoning By-law 569-2013 for the lands at 1202 and 1204 Avenue Road substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 7 to the report (April 4, 2019) from the Director, Community Planning, North York District.

3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required. 4. City Council authorize the City Solicitor, prior to introducing the necessary Bills to City Council for enactment, to enter into an Agreement with the Owner pursuant to Section 37 of the Planning Act, which agreement shall be registered against title to the lands at 1202-1204 Avenue Road, all to the satisfaction of the City Solicitor, to secure as a community benefit at the Owner's expense a cash contribution from the Owner of $35,000 to be directed to the Capital Revolving Fund for Affordable Housing and to be put towards the provision of new affordable housing.

This application proposes to amend the former City of North York Zoning By-law 7625 and the new City-wide 569-2013 Zoning By-law at 1202 and 1204 Avenue Road to permit a seven unit, three-storey townhouse development at the north-west corner of Avenue Road and Hillhurst Boulevard. Access to seven rear parking spaces is proposed via a driveway entering and exiting from Hillhurst Boulevard. The proposed development is consistent with the Provincial Policy Statement (2014) and conforms with the Growth Plan for the Greater Golden Horseshoe (2017).

    North York Community Council commenced a statutory public meeting on April 24, 2019 and notice was given in accordance with the Planning Act. At its meeting on May 22, 2019, the North York Community Council also considered the report (May 21, 2019) from the Director, Community Planning, North York District, which confirms the proposal does conform with the "A Place to Grow" Plan, 2019.     Requested that City Planning staff, prior to the completion of the Site Plan Approval application at 1202-1204 Avenue Road, ensure that an agreement between the owners of 1202-1204 Avenue Road and 1206 Avenue Road is executed and registered on title to ensure that the existing driveway between 1204 Avenue Road and 1206 Avenue Road will remain unobstructed for the purposes of driveway access to the rear of 1206 and 1208 Avenue Road, to the satisfaction of the Chief Planner and Executive Director, City Planning Division.
