City Council issue the confidential instructions to staff attached to motion 1 by Councillor John Filion, such instructions to remain confidential, and City Council direct the City Manager to report to the Audit Committee on the outcome. 2. City Council request the Auditor General to report further to the Audit Committee on this matter. 3. City Council receive the report (June 24, 2020) from the City Solicitor and the General Manager, Parks, Forestry and Recreation for information and City Council direct that Confidential Attachment 1 to the report (June 24, 2020) from the City Solicitor and the General Manager, Parks, Forestry and Recreation remain confidential.

City Council receive the supplementary report (July 27, 2020) from the City Solicitor and the General Manager, Parks, Forestry and Recreation and City Council direct that Confidential Attachment 1 to the supplementary report (July 27, 2020) from the City Solicitor and the General Manager, Parks, Forestry and Recreation remain confidential. The confidential instructions to staff attached to motion 1 by Councillor John Filion remain confidential in their entirety in accordance with the provisions of the City of Toronto Act, 2006, as they pertain to advice or communications that are subject to litigation and solicitor-client privilege. This report explains the results of the review conducted by Parks, Forestry and Recreation of work performed by tree maintenance vendors, which was undertaken in response to City Council's direction to the General Manager, Parks, Forestry and Recreation and arising out of the Auditor General's April 26, 2019 Report "Ensuring Value for Money for Tree Maintenance Services". It also provides advice with respect to potential legal action.

Staff recommended

The General Manager, Parks, Forestry and Recreation and the City Solicitor recommend that: 1. City Council adopt the confidential instructions to staff in Confidential Attachment 1. 2. City Council authorize the public release of the confidential recommendations contained in Confidential Attachment 1, at the discretion of the City Solicitor, but that the remainder of Confidential Attachment 1 remain confidential as it contains advice which is subject to solicitor-client privilege.
