The Toronto and East York Community Council: 1. Directed the General Manager, Transportation Services, to enter into an Encroachment Agreement with the property owner at 64 Oxford Street to maintain encroachments in the municipal boulevard abutting the Augusta Road flank of the property.

The Urban Herbivore at 64 Oxford St opened in May 2005 as a vegan food shop, and shortly afterwards, built an enclosure as an addition to the building through a Marketing Enclosure permit. In the fall of 2019, they received notice the City was updating the boulevard licencing system. After signing a Marketing Display agreement, Municipal Licencing and Standards informed the owner that the structure is actually a permanent extension to the address and would not be eligible for a Marketing Display renewal in October 2020.

Enclosures and build-outs on small businesses in Kensington are integral to its character and built form, and were identified as a heritage attribute in the City's Kensington Market Heritage Conservation District (HCD) Study. As the preparation of the HCD Plan is still in progress, an encroachment agreement is needed in order to legally maintain and preserve this structure.
