City Council authorize the City Solicitor to retain outside consultants as may be necessary in order to oppose the Appeal.

This Motion will authorize the City Solicitor, along with appropriate City Staff or outside consultants, as necessary, to support the Committee of Adjustment's decision refusing the minor variance application at 197 Greyabbey Trail, Application A0021/21SC, (the "Application") and attend the Toronto Local Appeal Body in order to oppose the Application. The Application seeks to construct a new three storey detached dwelling.

The Application required the Committee of Adjustment's approval of four (4) proposed variances to Zoning By-law 569-2013, and one (1) proposed variance of Zoning By-law 9676. The variances sought relate to the increase of the gross floor area, the increase of the dwelling height, the construction of a third storey, and an increase to the maximum number of platforms permitted at or above the second storey, on the front of the dwelling. Planning staff did not file a report to the Committee of Adjustment with respect to the Application. The Committee of Adjustment refused the Application in its decision issued on December 8, 2021. Subsequently, the owner of 197 Greyabbey Trail appealed the Decision to the Toronto Local Appeal Body. This Motion will direct the City Solicitor to attend the Toronto Local Appeal Body in order to oppose the Appeal. No hearing date has been scheduled yet.
