The confidential instructions to staff in Confidential Attachment 1 to the report (October 31, 2025) from the City Solicitor were adopted by City Council and Part 1 is now public as follows: 1. City Council authorize the City Solicitor, with retroactive authority, to bring an application for judicial review, motion for leave to appeal, and if granted, to appeal to Divisional Court, from the October 10, 2025, decision of the Ontario Land Tribunal regarding the property at 155 St. Dennis Drive. The balance of Confidential Attachment 1 to the report (October 31, 2025) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.

On October 10, 2025, the Ontario Land Tribunal issued a decision approving an Official Plan and Zoning By-law Amendment pursuant to section 22 and 34 of the Planning Act for the property at 155 Saint Dennis Drive. The Tribunal also heard submissions with respect to a site plan control application but deferred consideration of that appeal sine die. The Ontario Land Tribunal Act allows parties to a hearing to seek a review of a decision within the Tribunal system and to seek leave to appeal an Ontario Land Tribunal decision to the Divisional Court.
