City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (October 31, 2025) from the City Solicitor. 3. City Council direct that the balance of Confidential Attachment 1 to the report (October 31, 2025) from the City Solicitor remain confidential at the discretion of the City Solicitor, as it contains advice that is subject to solicitor-client privilege.

The confidential instructions to staff in Confidential Attachment 1 to the report (October 31, 2025) from the City Solicitor were adopted by City Council and are now public as follows: 1. City Council direct that if the Ontario Land Tribunal allows the request of the owner of 1196-1204 Yonge Street and 1206-1204 Yonge Street and 208 Birch Avenue to review its October 10, 2024 decision, the City Solicitor should support the owner's revised proposal. 2. City Council authorize the City Solicitor to take all necessary actions to implement City Council's decision. The balance of Confidential Attachment 1 to the report (October 31, 2025) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege. The balance of Confidential Attachment 1 to the report (October 31, 2025) from the City Solicitor will be made public at the discretion of the City Solicitor.

On April 17 and 18, 2024 City Council considered and accepted a settlement offer from the owner of 1196 to 1204 Yonge Street, 1206 to 210 Yonge Street and 2 to 8 Birch Avenue. The Ontario Land Tribunal issued a decision on October 10, 2024, approving the proposed development as set out in the settlement offer. The applicant has requested that the Ontario Land Tribunal review its decision. The City Solicitor requires instructions in response to this review request.
