Since the last update to the Board of Directors of TO Live in June 2025, City staff from Corporate Real Estate Management (CREM), Purchasing and Materials Management (PMMD), and Legal Services continue to work collaboratively with TO Live to transfer oversight of the implementation of TO Live's 2025-2034 Capital Budget and Plan, as well as future capital plans, from TO Live to Corporate Real Estate Management. Staff established and implemented two agreements as of Q3 2025 - a Service Level Agreement, and a Management Agreement to govern both the transition and the future working relationship between Corporate Real Estate Management and TO Live.

These agreements provide a clear methodology and governance framework to ensure the timely delivery of in-flight and urgent projects initiated prior to the adoption of EX19.20, and a smooth transition of capital oversight responsibilities and the effective delivery of future capital programs. In addition, the approved 2025 Capital Budget for TO Live will be transferred from TO Live to Corporate Real Estate Management through the Q2 2025 capital variance report, once adopted by City Council. Corporate Real Estate Management has also continued to advance the State of Good Repair (SOGR) strategy for the St. Lawrence Centre for the Arts (STLC) in collaboration with TO Live. Through Council direction in EX19.20, the Board of Directors of TO Live was requested to update the Executive Director, Corporate Real Estate Management, on formal commitments for additional non-City capital funding for the St. Lawrence Centre for the Arts by no later than June 30, 2025. The Board of Directors of TO Live has not advised of any such commitments, and the planning and scope-setting phase for the St. Lawrence Centre for the Arts SOGR program is underway and will conclude in September 2025, with construction set to begin in 2026. Should additional non-City funding become available in the future, Corporate Real Estate Management will work with TO Live to assess how best to integrate those resources into an enhanced State of Good Repair program, as directed in Recommendation 3 in EX19.20, "wherein the additional funds shall be directed towards fulfilling outcomes identified in the community consultations outlined in the report (September 6, 2024) from the President and Chief Executive Officer, TO Live on St. Lawrence Centre for the Arts Redevelopment Project".
