City Council direct that Confidential Attachment 1 to the report (March 11, 2026) from the City Solicitor remain confidential in its entirety as it contains advice or communications that are subject to solicitor-client privilege and relates to litigation or potential litigation.

3. City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (March 11, 2026) from the City Solicitor, at the discretion of the City Solicitor. Confidential Attachment 1 to the report (March 11, 2026) from the City Solicitor remains confidential in its entirety at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice or communications that are subject to solicitor-client privilege and relates to litigation or potential litigation. The confidential instructions to staff in Confidential Attachment 1 to the report (March 11, 2026) from the City Solicitor will be made public at the discretion of the City Solicitor.

At its meeting of November 12 and 13, 2025 City Council instructed the City Solicitor to bring an application for judicial review, motion for leave to appeal, and if granted, to appeal to Divisional Court, from the October 10, 2025, decision of the Ontario Land Tribunal regarding the property at 155 St. Dennis Drive. Following the 155 St. Dennis Decision, the Ontario Land Tribunal also rendered a decision on related issues concerning a separate development at 7553 Islington Avenue in the City of Vaughan.
