This staff report concerns a matter for which the Etobicoke York Community Council has delegated authority from City Council to make a final decision. This report responds to an application submitted by the property owner of 24 Totteridge Road, requesting approval for a site-specific Fence Exemption under Toronto Municipal Code, Chapter 447 - Fences, for a proposed pool fence located at 24 Totteridge Road within the Etobicoke York District.

The purpose of this report is to advise Community Council of an application submitted by the owner of 24 Totteridge Road requesting a site-specific Fence Exemption pursuant to Section 447-1.3.E.(2)(a)-(e) of Toronto Municipal Code Chapter 447 - Fences. The owner is seeking approval to maintain an existing fence constructed of black composite material with steel posts, to be used as a pool fence enclosure along the north and east sides of the rear yard. The proposed fence does not create any sightline obstruction. Municipal Licensing and Standards Division staff have not issued a Notice of Violation for the property.

The District Manager, Municipal Licensing and Standards, West District recommends that Etobicoke York Community Council: 1. Refuse to grant the application for exemption by the owner of 24 Totteridge Road because the fence fails to comply with the provisions of Toronto Municipal Code, Chapter 447 Fences.
