2775 Jane Street - Zoning By-law Amendment - Decision Report - Approval
This report recommends approval of the application to amend the Zoning By-law to permit a 27-storey (89.4 metres, excluding the mechanical penthouse) infill residential building north of the existing 17-storey apartment building at 2775 Jane Street. The proposed building includes approximately 420 dwelling units and a residential gross floor area of 26,593 square metres.

The Director, Community Planning Etobicoke York District recommends that: 1. City Council amend City of Toronto Zoning By-law 569-2013 for the lands municipally known as 2775 Jane Street substantially in accordance with the draft Zoning By-law Amendment included as Attachment 5 to this Report. 2. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required. 3. City Council direct that before introducing the necessary Bills to City Council for enactment the applicant be required to withdraw its appeal of the Jane Finch Secondary Plan (Official Plan Amendment 633) to the Ontario Land Tribunal within Ontario Land Tribunal Case OLT-24-000833, or make other legal arrangements deemed acceptable to the City Solicitor. 4. City Council request the Executive Director, Development Review, in consultation with the Chief Planner and Executive Director, City Planning, to secure the following through the Site Plan Control process for the lands, pursuant to Section 114 of the City of Toronto Act, 2006: a. continue to provide and maintain the existing 198 rental dwelling units at 2775 Jane Street as rental housing for a period of at least 20 years commencing from the date the Zoning By-law Amendment comes into force and effect, with no application for demolition or conversion from residential rental use during the 20- year period, to the satisfaction of the City Solicitor and the Executive Director, Development Review; and b. The Owner shall undertake improvements to the existing rental building, at its sole expense and at no cost to the tenants, at 2775 Jane Street, as follows: 1. access to new outdoor amenities at grade and ground floor indoor amenities in the proposed new building for tenants of the existing rental apartment building; 2. enhanced landscaped areas and new walkways; 3. enhanced pick-up and drop-off area; 4. new seating area in the laundry room; and 5. new screening fence around the outdoor garbage storage area. 5. Prior to Site Plan Approval for the proposed development, City Council require the Owner to develop a Construction Mitigation and Tenant Communication Plan, including a Parking Plan to mitigate the impacts of construction of the development on tenants of the existing rental building, to the satisfaction of the Executive Director, Development Review. 6. City Council authorize the modification of the existing three-legged signalized intersection of Jane Street and Eddystone Avenue, including but not limited to the addition of traffic control signals at the intersection of Jane Street and Eddystone Avenue/the proposed Private Driveway. The Owner shall design, fund, and construct the traffic control signals to the satisfaction of the Director, Engineering Review, Development Review and the General Manager Transportation Services, the cost of which will be secured through the Site Plan Application. 7. Subject to approval of Recommendation 6 above, City Council amend the existing traffic control signals at Jane Street and Eddystone Avenue to be in effect at Jane Street and Eddystone Avenue / Private Access.

2351 and 2355 Keele Street - Zoning By-law Amendment Application- Appeal Report
On September 23, 2022, the City received Zoning By-law Amendment and Site Plan Control applications for a 25‑storey residential building proposed at 2351 and 2355 Keele Street with approximately 22,540 square metres of gross floor area and 311 residential units. On June 30, 2023, the applicant appealed the applications to the Ontario Land Tribunal (OLT) citing City Council's failure to make a decision on the applications within the time period prescribed under the Planning Act. A Case Management Conference was held on September 26, 2023 (OLT Case No. OLT-23-000689 and OLT-23-000690). The OLT hearing date has not been scheduled. This Report recommends that the City Solicitor with the appropriate City Staff attend the OLT hearing to oppose the application in its current form and to continue discussions with the applicant to resolve any outstanding issues. An Official Plan Amendment application (25 206929 OZ WET 05 OZ) has been submitted for the entire North Park Plaza site, including the portion of the site that is the subject of this report. The Official Plan Amendment application proposes to establish principles for the entire plaza site, should it be redeveloped in the future. It does not propose any specific buildings. The Official Plan Amendment application has not been appealed and is currently under review.
The Etobicoke York Community Council recommends that: 1. City Council direct the City Solicitor and appropriate City staff to attend the Ontario Land Tribunal in opposition to the current application regarding the Zoning By-law Amendment appeal for the lands at 2351-2355 Keele Street, and to continue discussions with the applicant to resolve outstanding issues. 2. City Council authorize the City Solicitor and City Staff to take any necessary steps to implement City Council's decision, including requesting any conditions of approval that would be in the City's interest, in the event the Ontario Land Tribunal allows the appeal, in whole or in part.

174 Church Street - Application to Remove a Private Tree
This report requests that Etobicoke York Community Council deny the request for a permit to remove one privately owned tree located at 174 Church Street. The applicant indicates the reason for requesting the removal of the tree is to accommodate the construction of a new basement walkout access associated with a proposed multiplex development. The Colorado blue spruce tree ( Picea pungens ) measures 42 cm in diameter. The City's Tree By-laws do not support the removal of this tree as it is healthy and maintainable. The permit was denied, and the applicant is appealing the decision. The Community Council has delegated authority from City Council to make a final decision as to whether a permit may be issued when an applicant appeals the City's decision to deny a tree permit.

31 Queen Anne Road - Application to Remove a Private Tree
This report requests that Etobicoke York Community Council deny the request for a permit to remove one privately owned tree located at 31 Queen Anne Road. The applicant indicates the reason for requesting removal of the tree is a concern expressed by the homeowner regarding safety related to dead branches in the crown of the tree. The honey locust tree ( Gleditsia triacanthos ) measures 67 cm in diameter. The City's Tree By-laws do not support the removal of this tree as it is healthy and maintainable. The permit was denied, and the applicant is appealing the decision. The Community Council has delegated authority from the City Council to make a final decision as to whether a permit may be issued when an applicant appeals the City's decision to deny a tree permit.

280 Driftwood Avenue - Request for a Fence Exemption to the Toronto Municipal Code, Chapter 447
This staff report concerns a matter for which the Etobicoke York Community Council has delegated authority from City Council to make a final decision. This report responds to an application submitted by the property owner of 280 Driftwood Avenue requesting approval for a site-specific Fence Exemption under Section 447-1.2B(1) of Toronto Municipal Code Chapter 447 - Fences. The property owner is requesting Council's permission to maintain an existing wood fence, including its posts, with heights ranging from approximately 2.21 metres to 2.31 metres. The fence exceeds the maximum height allowed for residential properties under Chapter 447. Municipal Licensing and Standards staff inspected the property and confirmed that the fence is taller than permitted. As a result, a Fence Exemption is required for the fence to remain in its current form.

This report responds to an application submitted by the property owner of 24 Totteridge Road, requesting approval for a site-specific Fence Exemption under Toronto Municipal Code, Chapter 447 - Fences, for a proposed pool fence located at 24 Totteridge Road within the Etobicoke York District. The purpose of this report is to advise Community Council of an application submitted by the owner of 24 Totteridge Road requesting a site-specific Fence Exemption pursuant to Section 447-1.3.E.(2)(a)-(e) of Toronto Municipal Code Chapter 447 - Fences. The owner is seeking approval to maintain an existing fence constructed of black composite material with steel posts, to be used as a pool fence enclosure along the north and east sides of the rear yard. The property owner is seeking Community Council's permission to maintain: - An existing wood fence along the south lot line with a height of 2.47 metres; and - A post-and-frame structure around the gate with a height of 2.14 metres
The Etobicoke York Community Council: 1. Granted the application for a fence exemption permit to the property owners of 87 Delemere Avenue, thereby allowing the current fence to be maintained. 2. The property owner will indemnify the City of Toronto from and against all actions, suits, claims or demands and from all loss, costs, damages, and expenses that may result from such permission granted; b. The property owner will maintain the subject fence at their own expense in good repair and a condition satisfactory to the General Manager of Transportation Services and will not make any additions or modifications to the encroachment beyond what is allowed under the terms of the Agreement; c. The property owner will accept such additional conditions as the City Solicitor or the General Manager of Transportation Services may deem necessary in the interest of the City; d. The property owner will remove the subject fence upon receiving written notice from Transportation Services to do so; e. The property owner will enter into an encroachment agreement with the City of Toronto, at the applicant's expense, and assume all liability and damages related to the encroachments; f. As the Toronto Transit Commission (TTC) operates a transit service on Grand Avenue, City Council approval of this report is required. Transportation Services has reviewed the need for pedestrian crossing protection at Grand Avenue and Algoma Street. Based on the assessment undertaken, Transportation Services does not recommend the installation of pedestrian crossing protection at Grand Avenue and Algoma Street as the warrant criteria was not met for either a pedestrian crossover (PXO) or traffic control signals.

Highway 27 and Rexdale Boulevard - Pedestrian Crossing Protection
As the Toronto Transit Commission (TTC) operates a transit service on Highway 27, City Council approval of this report is required. Transportation Services has reviewed the need for pedestrian crossing protection at the northbound, southbound and westbound right-turn channels at the intersection of Highway 27 and Rexdale Boulevard. Based on the assessment undertaken, Transportation Services is recommending the installation of a pedestrian crossover (PXO) at these locations. The PXOs will provide enhanced safety for vulnerable road users. During the course of the investigation, it was noted that there is a discrepancy between posted signs and the yield sign regulations. Recommendation 2 will correct this inconsistency.

54 Atomic Avenue Driveway and North Queen Street - Turn Prohibition
Transportation Review is requesting approval for the implementation of a left-turn prohibition at the North Queen Street access driveway for the industrial redevelopment at 54 Atomic Avenue. As the Toronto Transit Commission (TTC) operates transit service on North Queen Street, City Council approval of this report is required. The proposed regulation is needed to address operational and safety concerns related to conflicting turning movements and driveway spacing. Restricting left-turn movements for vehicles exiting the westerly driveway at 54 Atomic Avenue onto North Queen Street will support safer and more efficient traffic operations along North Queen Street.

Authorized the Fire Chief and City Solicitor to take the appropriate action to make a designated Fire Route.
