The Applicant for 33 Falaise Road has requested Scarborough Community Council to exempt their property from the following by-law requirements: City of Toronto Municipal Code Chapter 447 1.2B(1) - Restrictions on Fences; Fence height. City of Toronto Municipal Code Chapter 447 1.2C(1) - Restrictions on Fences; Open-fence construction required The fence on the front yard on the south side of the property constructed of concrete and metal picket's measures approximately 1.95 metres in height.

The fence on the front yard North and West sides is constructed of stone pillars with metal picket fencing in between. It is measured at approximately 1.29 metres in height for the metal pickets and approximately 1.95 metres in height for the stone pillars including the lamps. The fence gate is constructed of metal pickets and is measured at approximately 2.5 metres in height at the highest point and 1.75 metres in height at the lower points. The fence in the front yard is constructed of concrete and partial stone and is not open fence construction as required in the bylaw. Municipal Licensing and Standards Division has inspected the subject property and issued a notice of violation of City of Toronto Municipal Code Chapter 447 1.2 B.(1) and 1.2 C.(1)

Refuse to grant an exemption to Chapter 447, Fences, to the property owner of 33 Falaise Road, for the existing fence described in the Summary of this report.
