2491947 Ontario Inc. has submitted an application for a new liquor licence to the Alcohol and Gaming Commission of Ontario for a premises at 12 Trinity Street operating under the name Spirit of York Distillery Inc. The Premises is located adjacent to the City's Distillery District near a large concentration of licenced establishments. It is also located in close proximity to many residential properties. These are sensitive uses that may be impacted by the Premises. Considering the proximity to sensitive uses, and the proposed capacity of an outdoor patio, the application for the licence should not be granted unless suitable conditions are placed on the licence to prevent impacts on the neighbouring community. This matter is deemed urgent as the deadline to object to the application was August 21, 2019.
City Council on October 2 and 3, 2019, adopted the following: 1. City Council direct the City Clerk to advise the Registrar of the Alcohol and Gaming Commission of Ontario that the issuance of a liquor licence for Spirit of York Distillery Inc., 12 Trinity Street, is not in the public interest having regard to the needs and wishes of the residents unless conditions are placed on the licence and that the Registrar should issue a Proposal to Review the liquor licence application. 2. City Council request the Alcohol and Gaming Commission of Ontario or the Licence Appeal Tribunal to provide the City of Toronto with an opportunity to participate in any proceedings with respect to the Premises. 3. City Council authorize the City Solicitor to attend all proceedings before the Alcohol and Gaming Commission of Ontario or the Licence Appeal Tribunal in this matter and City Council direct the City Solicitor to take all necessary actions so as to give effect to this Motion, including adding conditions to any liquor licence issued for the Premises.

On March 27 and 28, 2019, Council adopted Item EX3.8 - Renewing the City's Commitment to Toronto Global. In adopting this Item, Council authorized the execution of a five-year funding agreement with Toronto Global, subject to certain terms and conditions including that the Province of Ontario and all participating municipalities also make five-year funding commitments to Toronto Global. The City has learned that the Province of Ontario has signed an agreement whereby it has only committed to a three-year term. It is also now understood that certain participating municipalities will only commit to a three-year term. While it is still desirable for the City to enter into the funding agreement, it would make sense for the City's commitment to be reduced to a three-year period, consistent with the Province and other participating municipalities. Staff will be able to report back on a further renewal in the future if it appears that the Province and partner municipalities are also willing to extend their commitments. This matter is urgent because the agreement with Toronto Global is on track to be executed before the end of October 2019. Requires Re-Opening: This Motion requires a reopening of Executive Committee Item EX3.8, (March 27 and 28, 2019) only as it relates to the requirement for the Province of Ontario to enter into a five-year funding commitment.

The introductory paragraph of Part 1 be amended by replacing "2024" with "2022" and replacing the words "five-year" with "three-year"; 2. Part 1.a. be amended by replacing the words "five-year" with "three-year"; and 3. Part 1c. be deleted and replaced with the following: "1c. the Province of Ontario committing to enter into a funding agreement with Toronto Global for three years and the Government of Canada committing to enter into a funding agreement with Toronto Global for at least three years."

The lands municipally known as 30 Tippett Road are being developed in accordance with the City of Toronto's vision for the Tippett Road Regeneration Area, including the provision of 50 affordable purpose-built rental units and 50 affordable ownership units as part of the Investment in Affordable Housing Program. This iteration of the Investment in Affordable Housing Program began in 2014 and expires at the end of this year. The federal and provincial component of funding is time-limited and will be surrendered by the City if it is not utilized by the end of the year. Tippett South Inc. is under contract to deliver the loan funding for the City. The funding is secured from the Province by way of an agreement of purchase and sale with eligible purchasers, and all units are now under firm and binding agreements of purchase and sale. The mortgage approvals for all firm and binding agreements of purchase and sale for the 50 affordable ownership units were issued under a pricing model that reflects current development charge rates. If these units are subject to the scheduled development charge rate increase on November 1, 2019, these units' price will increase and the mortgages will not hold.

Councillor James Pasternak, seconded by Councillor Shelley Carroll, recommends that: 1. City Council authorize the execution of a development charge agreement between the City of Toronto and Tippett South Inc., the owner of 30 Tippett Road, in a form satisfactory to the City Solicitor, to allow all of the development charges for the 30 Tippett Road project [Building Permit File No. 19 156908 BLD 00NB (Building A) and 19 15 7198 BLD 00 NB (Building B)] to be paid before such charges would otherwise be payable and prior to November 1, 2019, pursuant to Section 415-8C of the City of Toronto Municipal Code. 2. City Council direct that Tippett South Inc. advance the financial contribution in the amount of One Million Nine Hundred and Fifty Thousand Dollars ($1,950,000.00) per the registered Section 37 Agreement payable to the City prior to issuance of the first below-grade building permit.
