4500 Jane Street - Zoning By-law Amendment Application - Decision Report - Approval
This application proposes to amend city-wide Zoning By-law 569-2013 and former City of North York By-law 7625 for the lands at 4500 Jane Street. The proposed zoning would permit two six-storey mid-rise buildings fronting onto Gosford Boulevard and retain the existing 14-storey rental apartment building. The proposal is a positive example of compatible and sensitive infill development in Apartment Neighbourhoods. At the ground level the proposed building is well articulated and massed along Gosford Boulevard. Generous setbacks allow for a double row of trees on Gosford Boulevard and Milo Park Gate, offering a greener setting for existing and future residents. The recommended building heights of 20 metres respond to the right-of-way width of Gosford Boulevard and is reflective of a mid-rise built form typology that has appropriate regard for the Avenues and Mid-rise Buildings Study and Performance Standards ("Mid-rise Guidelines"). The infill development proposal also offers improvements to the existing apartment building and site conditions. These improvements will help to extend the life of the existing rental apartment building, promote environmental sustainability, and contribute to a high quality urban environment and residential amenities.
The Etobicoke York Community council recommends that: 1. City Council amend Zoning By-law 569-2013 for the lands at 4500 Jane Street substantially-in-accordance with the draft Zoning By-law Amendment attached as Attachment 13 to the report (April 26, 2023) from the Director, Community Planning, Etobicoke York District. 2. City Council amend Zoning By-law 7625, for the lands at 4500 Jane Street, substantially-in-accordance with the draft Zoning By-law Amendment attached as Attachment 14 to the report (April 26, 2023) from the Director, Community Planning, Etobicoke York District. 3. City Council require the owner to enter into an agreement or undertaking pursuant to Section 3.2.1.5 of the Official Plan to secure the following matters as a legal convenience to support development as follows: a. the owner shall continue to provide and maintain the existing 164 units at 4500 Jane Street as rental housing for a period of at least 20 years commencing from the date the Zoning By-law Amendments come into force and effect, with no application for demolition or conversion to condominium ownership or from residential rental use during the 20-year period, all to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor. b. The owner shall undertake improvements, at its sole expense and at no cost to tenants to the existing rental building at 4500 Jane Street, as follows: 1. Access to new outdoor amenities and ground floor indoor amenities in the proposed new buildings for tenants of the existing rental apartment building; 2. Plumbing, boiler, and mechanical upgrades, including replacement of galvanized risers to copper risers; and 3. Parking garage and exterior asphalt upgrades, including pavement rehabilitation and garage roof repair. 4. Prior to Notice of Approval Conditions for Site Plan Control approval for the development, City Council require the owner to submit a Construction Mitigation and Tenant Communication Plan, including an interim parking plan, to mitigate the impacts of construction of the development on tenants of the existing rental building, all to the satisfaction of the Chief Planner and Executive Director, City Planning. 5. City Council authorizes the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required.

This staff report is about a matter for which the Etobicoke York Community Council has delegated authority to make a final decision. In accordance with city-wide residential demolition control under the Toronto Municipal Code Ch.363, under the authority of Section 33 of the Planning Act, the applications for the demolition of four existing 1 storey frame dwellings located at 14, 18, 24 and 26 Jopling Avenue South (Application No. 23 104812 DEM 00 DM, 23 104821 DEM 00 DM, 23 104828 DEM 00 DM & 23 104831 DEM 00 DM) are being referred to the Etobicoke York Community Council to refuse or grant the demolition applications, including any conditions to be attached to the permits, because a building permit has not been issued for a replacement building.
The Etobicoke York Community Council: 1. Approved the application to demolish the vacant residential building with the following conditions: a. That construction fences, with 50 percent art, be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official; b. That all debris and rubble be removed immediately after demolition; and c. That any holes on the property are backfilled with clean fill.

This report requests that Etobicoke York Community Council deny the request for a permit to remove one City-owned tree located at 150 Hillside Avenue. The applicant indicates the reason for requesting removal of the tree is to allow for construction of a proposed asphalt driveway. The sugar maple tree, Acer saccharum, measures 86 cm in diameter. The City's Tree By-laws do not support the removal of this tree as it is healthy and maintainable. Community Council has delegated authority from City Council to make a final decision as to whether a permit may be issued when an applicant wishes to appeal the City's decision to deny a tree permit.

19 Disan Court - Application to Remove a Private Tree

Woodstream Drive - Parking Amendments and Heavy Truck Prohibition
This staff report is about a matter that Community Council has delegated authority from City Council to make a final decision. Transportation Services is recommending parking prohibitions on the east and west side of Woodstream Drive, between Rexdale Boulevard and Humberwood Boulevard. These proposed regulations will improve vehicle movements by maintaining a clear passage and improve visibility and safety for all road users and park users. Chalkfarm Drive - Parking Amendments

Snow Plough Damage To Sod Along Sidewalks and Other Landscape Features within the Road Right of Way
Following the recent 2022-23 winter season, there has been concerns over snow plough damage to property and sod along sidewalks and other landscape features within the public road right of way. The purpose of this report is to respond to the April 3, 2023 Etobicoke York Community Council's direction for an update concerning the extent of damage, the plan to make repairs, an overview of the responsibilities of the City, the snow clearing contractor, and of residents, and on progress toward making repairs this spring.
The Etobicoke York Community Council: 1. Requested the Director, Operations and Maintenance, Transportation Services to review the findings of the report of the property and sod damage provided to Etobicoke York Community Council Members with the snow clearing contractor. 2. Requested the Director, Operations and Maintenance, Transportation Services provide a communication on timelines to the members of the Etobicoke York Community Council that can be shared with the public. 3. Directed the Director, Operations and Maintenance, Transportation Services to identify the source of complaints/reports in future communications to Councillors. 4. Requested the Director, Operations and Maintenance, Transportation Services to develop a visual marker that can be placed on locations that are designated for repair to inform the public of the work.

The purpose of this report is to obtain the City Council's approval to grant a permanent easement to Cloverdale Mall Inc. (Cloverdale) for the airspace surrounding an existing bridge (Bridge) owned by Cloverdale, over The East Mall. To date, Cloverdale does not have a registered easement over this airspace but the decision of the Honourable Justice Susan Vella on July 27, 2021 in Cloverdale Mall Inc. v. City of Toronto, 2021 ONSC 5235, Court File No. CV-20-00636972 (the "Court Decision") confirmed that Cloverdale enjoys an implied easement of necessity over the airspace surrounding the bridge. This report is required to authorize the registration of an easement, on terms negotiated between Cloverdale and the City and acceptable to the City Solicitor, to give effect to the Court Decision. The location and boundaries of the proposed easement in favour of Cloverdale are shown in Appendix A and substantially on the terms and conditions outlined in Appendix B.

City Council grants authority to enter into the permanent easement agreement with Cloverdale for the airspace surrounding the existing Cloverdale Bridge over The East Mall, as shown on the Reference Plan in Appendix A and substantially on the terms and conditions outlined in Appendix B, to the report (April 27, 2023) from the Director, Transportation Planning and Capital Program, Transportation Services and on such further terms as may be acceptable to the General Manager, Transportation Services and in a form satisfactory to the City Solicitor.

Residents have contacted me concerned about the safety on Muir Ave near Islington Ave. Recent Vision Zero markings have narrowed the available roadway at the intersection and with cars parking nearly to the intersection it has created a dangerous situation. I am recommending limiting parking on Muir Ave.
