Pursuant to section 170(2) of the City of Toronto Act, 2006 (COTA), Ombudsman Toronto has concluded an Enquiry to review how the City of Toronto handles homeowners' third-party liability claims for basement flooding and sewer backups. We hereby table with City Council for its November 25 and 26, 2020 session the Enquiry Report, dated November 12, 2020.
The General Government and Licensing Committee recommends that: 1. City Council adopt the Ombudsman Toronto Report (November 12, 2020) and in so doing, accept the Ombudsman's findings and direct the City administration to implement all of the recommendations. 2. City Council direct the General Manager, Toronto Water, in consultation with the Director of Insurance and Risk Management, Finance and Treasury Services, and the City Solicitor to report to the General Government and Licensing Committee in the second quarter of 2021 on recommended eligibility criteria and financial implications of providing a one-time no-fault grant for residential property owners and/or tenants in the Rockcliffe neighbourhood of Ward 5, York South-Weston, and other similarly impacted areas, who did not have basement flooding insurance coverage and reported one or more sewer back-up/basement flooding incidents to the City of Toronto as of a result of storm events during the time period January 1, 2018 to December 31, 2020 inclusive.

Expropriation of a Portion of 5795 Yonge Street for Public Street Purposes
The purpose of this report is to seek reauthorization from City Council to recommence proceedings for the expropriation of the fee simple interest and all other title, right and interest in certain lands forming part of the condominium property known municipally as 5795 Yonge Street. Reauthorization is required as the timelines for the final registration of the expropriation plan shown in (Appendix B) were not met and City Staff are required to recommence the proceedings for the expropriation of the required interests. The land to be expropriated is a small irregular piece of property required for the construction, maintenance and future repairs of a public street (the "Project").
The General Government and Licensing Committee recommends that: 1. City Council authorize the initiation of the expropriation process for the City to acquire part of the property at 5795 Yonge Street, depicted in Appendix A to the report (December 14, 2020) from the Executive Director, Corporate Real Estate Management, (the "Lands"), to complete the construction, maintenance and future repairs of a public street. 2. City Council authorize the Executive Director, Corporate Real Estate Management, or their designate, to serve and publish as required notices of Application for Approval to Expropriate Land, to forward to the Chief Inquiry Officer any requests for hearing that are received, to attend the hearing to present the City's position, and to report the Inquiry Officer's recommendations to City Council for its consideration.

The purpose of this report is to seek authority to amend Blanket Contract Number 47018623 issued to Cornerstone on Demand Incorporated as a result of Request for Proposal Number 3405-13-3008. The total amendment being requested will increase the Blanket Contract value by $200,000 net of all applicable taxes and charges ($203,520 net of Harmonized Sales Tax recoveries). This request for an increase in contract value is required to address an expenditure incurred as a result of the need to purchase online learning content for City staff earlier than planned. This expenditure was required as a result of the cancellation of all in-classroom learning as a result of COVID-19 pandemic restrictions. The online learning content was a critical component of the City's strategy to support the productivity, growth, resilience, health and well-being of all staff during an unprecedented time of anxiety and upheaval.
The General Government and Licensing Committee: 1. In accordance with Section 71-11.1C of the City of Toronto Municipal Code Chapter 71 (Financial Control), authorized an amendment to Blanket Contract Number 47018623 and increase the value of the contract by $200,000 net of all taxes ($203,520 net of Harmonized Sales Tax recoveries), revising the Blanket Contract value from $2,725,300 to $2,925,300 net of all applicable taxes and charges ($2,976,785 net of Harmonized Sales Tax recoveries) and authorizing the Chief People Officer to execute an amending agreement with Cornerstone on Demand.

The General Government and Licensing Committee, in accordance with Section 71-11.1C of the City of Toronto Municipal Code Chapter 71 (Financial Control), grant authority to amend Blanket Contract Number 47018623 and increase the value of the contract by $200,000 net of all taxes ($203,520 net of Harmonized Sales Tax recoveries), revising the Blanket Contract value from $2,725,300 to $2,925,300 net of all applicable taxes and charges ($2,976,785 net of Harmonized Sales Tax recoveries) and authorizing the Chief People Officer to execute an amending agreement with Cornerstone on Demand.

The purpose of this report is to request authority to amend and increase the value of Contract Number 47021159 issued to Barricade Traffic Services Incorporated for the non-exclusive supply and delivery of Traffic Cones. The total amendment being requested is for an additional amount of $1,040,674 net of Harmonized Sales Tax, increasing the overall contract value from $1,034,644 to $2,075,318. The contract is managed by the Materials Management and Stores section of Purchasing and Materials Management on behalf of all City Divisions. This Contract was used extensively to support response to COVID-19 over the course of the last nine months including several closures of City properties, City streets and facilities and supported ActiveTO, CurbTo and CafeTO. This Contract has been utilized to procure items such as traffic cones, barriers, road closure signs, candlesticks etc. to close off and block entry/access to these areas. This Contract amendment will be used to cover the current over expenditure and accommodate the urgent ongoing requirements in order to continue the supply for all City locations through the third option year and into the fourth and final optional year of the Contract.
The General Government and Licensing Committee: 1. In accordance with Section 71-11.1.C of the City of Toronto Municipal Code Chapter 71 (Financial Control), authorized an amendment to Contract Number 47021159 issued to Barricade Traffic Services Inc. for the non-exclusive supply and delivery of Traffic Cones for the City of Toronto's Purchasing and Materials Management Division in the amount of $1,040,674 net of Harmonized Sales Tax, increasing the contract value from $1,034,644 to $2,075,318 net of Harmonized Sales Tax. 2. Requested the General Manager, Transportation Services to consider clearly marking new traffic cone assets with "Property of the City of Toronto".

The purpose of this report is to request authority to amend Purchase Order Number 6048526 issued to Atlas Constructors Inc. as a result of Tender Number 224-2018 for the provision of construction services for the building of the new Clark Centre for the Arts, 191 Guildwood Parkway. The total Purchase Order Amendment being requested is for an additional amount of $280,500.00 net of all applicable taxes and charges. This requested amount is required to address the increased scope of work due to a combination of discovered unsuitable soils that had to be removed and replaced; Ontario Building Code / permit requested changes requiring additional fire proofing, fire ratings and relocating electrical services; drawing coordination changes for electrical and mechanical; costs due to COVID related and permit and site plan approval issuance delays; and landscape changes to add supports for monuments. Refer to Table 2 for more detail.

In light of the establishments contravention of the Province of Ontario's lockdown regulation under the Reopening Ontario Act (ROA), that prohibits indoor and outdoor dining it has been highlighted that the establishment was also operating without a business license. The City of Toronto supports business and is mandated to protect residents. As such there are regulations that all businesses must adhere to, including issued by the Toronto Public health Food safety program and other measures to ensure that business are operating safely and following regulations. It is important that the Executive Director to Municipal Licensing and Standards speaks on this issue to offer an explanation on how establishments can remain open without a business license.

Request for a Presentation on the Customer Experience Transformation and Innovation Program
According to a City of Toronto news release dated December 13, 2019, the City transitioned its Civic Innovation Office to a newly formed Customer Experience Transformation and Innovation (CXi) program effective January 1, 2020. This news release details the initiatives of the Civic Innovation Office to increase civic engagement with underrepresented people, which included testing a digital translation application tool to help citizens overcome language barriers to public participation in city services and governance. This office also championed Human Centred Design at the City as a means of approaching innovation and public engagement differently. Lastly, this news release notes that the CXi program was established as a means of unifying the City's customer service initiatives with a focus on improving the user experience and ensuring that residents have the best experience possible when they access City services.
