This staff report is in regards to a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to consider an application submitted by the owner(s) of 4 Cornell Avenue for a site-specific Fence Exemption, pursuant to the Toronto Municipal Code, Chapter 447- Fences. The property owner(s) is seeking Council's permission to be exempt from Chapter 447 - 1.2.C - Open-fence construction required and Chapter 447 -1.2 (B)(1) fence in front yard and within 2.4 m of a lot line abutting a public highway maximum height of 1.2m. The subject property 4 Cornell Avenue is located in Ward 20, on a residentially zoned property.

This staff report concerns a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to advise Council concerning an application by the property owners of 17 Applefield Drive for a site-specific Fence Exemption, pursuant to Section 447-5.C of Toronto Municipal Code, Chapter 447- Fences. The subject property, at the north east corner of Applefield Drive and Tordale Crescent, is a corner lot, with a one story detached residential dwelling. It is located in Ward 21, in a Residential Zoned Area south of Ellesmere Avenue East and west of Brimley Road. The proposed fence does not comply with Section 447-3 of Toronto Municipal Code, Chapter 447.

This staff report concerns a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision. The purpose of this report is to advise Council concerning an application by the owner(s) of 70 Falaise Road for a site-specific Fence Exemption, pursuant to Section 447-1.5 of Toronto Municipal Code, Chapter 447- Fences. The property owners are seeking Council's permission to be exempt concerning a proposed wrought iron fence to be located in the front of the property, which does not comply with restrictions contrary to Section 447- Section 447-1.2. B. (1) of the bylaw as detailed below in the following chart: The subject property on the west side of Falaise Road, is a corner lot, with a two story detached residential dwelling. It is located in Ward 24, in a Residential Zoned Area, north of Kingston Road and west of Morningside Avenue.

113-141 Montezuma Trail - Zoning By-law Amendment Application - Final Report
This application proposes to amend the Zoning By-laws to permit the construction of 37 back-to-back townhouse units on the northern portion of 113-141 Montezuma Trail while retaining the southern portion of the existing plaza for commercial uses. The back-to-back townhouse units are arranged into 2 rows and have a total gross floor area of 4,191 square metres. The retained commercial building will have a total gross floor area of 1,077 square metres. The proposed redevelopment of the subject property results in a floor space index (FSI) of 0.93. While originally submitted as a combined Official Plan and Zoning By-law amendment application, staff have determined that an amendment to the Official Plan is no longer required during the evaluation of the proposal. The proposed development is consistent with the Provincial Policy Statement (2014) and conforms with the A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2019). The proposed development represents an orderly development for the site that is appropriately scaled for lands designated Neighbourhoods. It is compatible with and provides an appropriate transition to adjacent land uses. The two rows of four-storey townhouses provide an appropriate level of intensification for the site. This report reviews and recommends the approval of the proposed application to amend the Zoning By-laws.
Scarborough Community Council recommends that: 1. City Council amend the former City of Scarborough Zoning By-law No. 12797, Agincourt North Community Zoning By-law, as amended, for the lands at 113-141 Montezuma Trail substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 6 to the report dated September 23, 2019, from the Director, Community Planning, Scarborough District. 2. City Council amend City of Toronto Zoning By-law 569-2013, as amended, for the lands at 113-141 Montezuma Trail substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 7 to the report dated September 23, 2019, from the Director, Community Planning, Scarborough District. 3. 1900 Eglinton Avenue East - Official Plan Amendment Application - Preliminary Report
This report provides information and identifies a preliminary set of issues regarding the application located at 1900 Eglinton Avenue East. Staff are currently reviewing the application. It has been circulated to all appropriate agencies and City divisions for comment.
Scarborough Community Council recommends that: 1. City Council determine that an Avenue Segment Study is not required given that City Planning Staff are undertaking a Secondary Plan Study for the Golden Mile area that includes the subject site.

39 - 45 Thora Avenue - Zoning Amendment - Application - Request for Directions Report
The applicant has appealed their applications for Zoning By-law Amendment and Site Plan approval to the Ontario Municipal Board (now transitioned to the LPAT) due to City Council's failure to make a decision within the timelines set out in the Planning Act. The hearing is scheduled for August 4, 2020. The application proposes to redevelop the site with 3 blocks of residential buildings comprising of the following: A 3-storey detached building containing 1 residential unit fronting onto Thora Avenue; A 3-storey townhouse block containing 5 residential units perpendicular to Thora Avenue and fronting onto a private walkway; A 3-storey townhouse block containing 10 residential units, located at the rear; and An underground parking garage containing 24 parking spaces, garbage /recycling room, storage area and an electrical room. The purpose of this report is to seek City Council's direction for the City Solicitor, together with appropriate City staff, to attend the LPAT hearing to oppose the application in its current form as it does not conform to the policies of the Official Plan. The proposed development is not respectful of the existing physical character of the adjacent established Neighbourhood, particularly in terms of site organization, prevailing building type, height, massing and scale. The adjacent neighbourhood is comprised of 1-2 storey detached and semi-detached dwellings that have direct access and frontage on public streets, have clearly visible main entrances and established landscaped open spaces and distances between buildings. The proposal represents overdevelopment of the site and would set a negative precedent in the neighbourhood. This report also recommends that the City Solicitor and appropriate staff be directed to continue discussions with the applicant in an effort to address the outstanding issues outlined in this report.
Scarborough Community Council recommends that: 1. City Council direct the City Solicitor and appropriate City Staff to attend and oppose the Zoning By-law Amendment and Site Plan applications in their current form for the lands at 39-45 Thora Avenue. 2. City Council direct the City Solicitor and City Staff to continue discussions with the applicant and seek revisions to the application in an attempt to resolve the outstanding issues outlined in the report dated October 21, 2019, from the Director, Community Planning, Scarborough District. 3. In the event that the Local Planning Appeal Tribunal allows an appeal of the Zoning By-law Amendment and Site Plan applications in whole or in part, City Council authorize the City Solicitor to request the Local Planning Appeal Tribunal to withhold its Order(s) approving the application until: a. The Tribunal has been advised by the City Solicitor that the proposed Zoning By-law Amendments are in a form satisfactory to the Chief Planner and Executive Director, City Planning Division; b. The owner submits to the satisfaction of the Executive Director, Engineering and Construction Services an updated Functional Servicing and Stormwater Management Report and plans. In addition, the owner would be required to enter into an agreement(s) for the construction of any improvements to existing municipal infrastructure, should it be determined that upgrades are required to support this development; and c. Conditions of Site Plan Approval are identified in a form satisfactory to the Chief Planner and Executive Director, City Planning Division. 4. City Council authorize the City Solicitor and other City staff to take any necessary steps to implement the foregoing.

Intention to Designate Under Part IV, Section 29 of the Ontario Heritage Act - 3315 Midland Avenue
This report recommends that City Council state its intention to designate the property at 3315 Midland Avenue under Part IV, Section 29 of the Ontario Heritage Act. The subject property is located on the east side of Midland Avenue at the north-east corner with South Shields Avenue in the Agincourt neighbourhood and contains a one-and-a-half storey house dating to c. 1875. In 2006, City Council listed the property at 3315 Midland Avenue, containing a house historically known as the George L'Amoreaux farm house (c.1875), on the City of Toronto's Inventory of Heritage Properties (now known as the Heritage Register). The property has been identified as having archaeological potential in accordance with the City of Toronto's Archaeological Master Plan. Following research and evaluation, it has been determined that the property at 3315 Midland Avenue meets Ontario Regulation 9/06, the criteria prescribed for municipal designation under Part IV, Section 29 of the Ontario Heritage Act for its design, associative and contextual value. The owner of the property at 3315 Midland Avenue has submitted a Notice of Intention to demolish a listed heritage property under the Ontario Heritage Act. The application is incomplete. In accordance with Official Plan Heritage Policies, properties on the Heritage Register will be conserved and maintained. Designation enables City Council to review alterations to the site, enforce heritage property standards and maintenance, and refuse demolition.

The Acting Chief Planner and Executive Director, City Planning Division, recommends that: 1. City Council state its intention to designate the property at 3315 Midland Avenue under Part IV, Section 29 of the Ontario Heritage Act, in accordance with the Statement of Significance: 3315 Midland Avenue (Reasons for Designation) attached as Attachment 3 to the report (November 15, 2017) from the Acting Chief Planner and Executive Director, City Planning Division. 2. Application to Remove a Private Tree - 94 Atlee Avenue
This report requests that City Council deny the request for a permit to remove one privately owned tree located at 94 Atlee Avenue. The application indicates the reasons for removal are that the tree is too large, dangerous, and too close to the house as well as the neighbour's house located at 92 Atlee Avenue, the ongoing costs of unclogging the sewer pipe and concerns that the roots will destabilize the veranda and stairs. The subject tree is a Colorado blue spruce (Picea pungens), measuring 51 cm in diameter. The Tree by-law does not support the removal of this tree as it is healthy and maintainable.

Parking and Stopping Regulations - Seasons Drive
As the Toronto Transit Commission (TTC) operates transit service on Seasons Drive, City Council approval of this report is required. Transportation Services recommends permitting short-term parking on the north side of Seasons Drive and prohibiting stopping on the south side of Seasons Drive during school hours at Blessed Pier Giorgio Frassati Catholic School. As a result of requests from the Councillor, Silver Springs Public School, St. Sylvester Separate School and residents regarding vehicle speeds on Silver Springs Boulevard, Transportation staff reviewed the need for traffic calming on Silver Springs Boulevard, between Perthshire Street and Wayside Avenue. Our assessment indicates the criteria as set out in the Traffic Calming Policy, has not been satisfied. Therefore, traffic calming measures are not recommended on Silver Springs Boulevard. Transportation staff also reviewed the feasibility of reducing the speed limit from 40 km/h to 30 km/h. Our assessment indicates that warrant criteria for the reduction of the speed limit from 40 to 30 km/h is also not satisfied. Therefore, a reduction of the speed limit to 30 km/h is not recommended for Silver Springs Boulevard.
