Final Report - 1050 Military Trail - Zoning Amendment Application
This application proposes to remove a Holding provision (H) to permit the development of an institutional building on the University of Toronto Scarborough (UTSC) campus at 1050 Military Trail, known as the Instructional Centre Phase 2 (IC2). The proposed building is five storeys (21.8 metres) in height, and contains approximately 14,930 square metres of gross floor area which includes classrooms, lecture halls, offices and some supporting retail use. This report reviews and recommends approval of the application to amend the Zoning By-law. The applicant has demonstrated through their supporting reports that the conditions for removing the holding provision (H) as set out in the Highland Creek Community Zoning By-law have been satisfactorily addressed.
Scarborough Community Council recommends that: 1. City Council amend Highland Creek Community Zoning By-law 10827, as amended, for the lands at 1050 Military Trail substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 5 to the report dated February 4, 2021 from the Director, Community Planning, Scarborough District. 2. Refusal Report 2872, 2880 and 2882 Kingston Road - Zoning Amendment Application
This application proposes to amend Cliffcrest Community By-law 9396 and City of Toronto Zoning By-law 569-2013 for the lands at 2872, 2880 and 2882 Kingston Road to permit a 10-storey mixed-use building. The proposal contains a total of 145 dwelling units and 295 square metres of ground floor commercial space. The total gross floor area would be 9,437 square metres resulting in a density of 4.99 times the lot area. A total of 118 vehicular parking spaces are proposed in three levels of underground parking. This report reviews and recommends refusal of the application to amend the Zoning By-law. The subject site is not appropriate for the size and scale of the development as proposed. The proposed development does not achieve appropriate transition to the lands to the north designated Neighbourhoods as required by the Official Plan and applicable Urban Design Guidelines. Additionally, the proposed development does not adequately minimize shadowing and overlook, particularly on adjacent streets and properties; and lacks sufficient landscaped open space. Further, the applicant has yet to file a Functional Servicing Report that adequately addresses whether sufficient servicing infrastructure is present to support the development. Taken together, these issues demonstrate an overdevelopment of the subject site in a manner that is not consistent with the Provincial Policy Statement (2020), does conform with the A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020), and does not conform to the City's Official Plan. For these reasons further outlined in this report, it is recommended that the application be refused in its current form.
Scarborough Community Council recommends that: 1. City Council refuse the application for Zoning By-law Amendment in its current form for the lands at 2872, 2880 and 2882 Kingston Road for the reasons outlined in the report dated February 5, 2021 from the Director, Community Planning, Scarborough District. 2. City Council authorize the City Solicitor, together with appropriate staff, to appear before the Local Planning Appeal Tribunal (LPAT) in support of City Council's decision to refuse the application, in the event that the application is appealed to the LPAT. 3. In the event that the Local Planning Appeal Tribunal allows the appeals in whole or in part, City Council direct the City Solicitor to request that the Tribunal withhold its Order until such time as: a. the Tribunal has been advised by the City Solicitor that the proposed Zoning By-law Amendments are in a form satisfactory to the Director, Community Planning, Scarborough District and City Solicitor; b. the City Solicitor confirms that the owner has provided a Functional Servicing and Stormwater Management Stage 1 Report, a Hydrogeological Report and Summary Forms for each Report, acceptable to the Chief Engineer and Executive Director, Engineering and Construction Services; and c. the City Solicitor request that a holding provision (H) be included in the final form of the zoning by-law, to be lifted at such time that the following conditions have been fulfilled to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services and General Manager, Toronto Water: i. upgrades of Wirral Sanitary Pumping Station and forcemain by the City have been constructed to solve the existing pumping station capacity constraints based on the findings of an Environmental Assessment (EA); ii. all local municipal infrastructure improvements or upgrades required to service the proposed development identified by the accepted Functional Servicing Report are secured or constructed; and iii. the Owner has entered into appropriate financially secured agreements to implement the required local infrastructure. 4. City Council authorize the City Solicitor and appropriate staff, in consultation with the Local Councillor, to continue discussions with the applicant to address the issues outlined in the report (February 5, 2021) from the Director, Community Planning, Scarborough District, and should a resolution be arrived at, to report back to City Council on the outcome, as appropriate. 5. City Council authorize the City Solicitor and any other City staff to take such actions as necessary to give effect to the recommendations of this report.

Intention to Designate Under Part IV, Section 29 of the Ontario Heritage Act - 3315 Midland Avenue
This report recommends that City Council state its intention to designate the property at 3315 Midland Avenue under Part IV, Section 29 of the Ontario Heritage Act. The subject property is located on the east side of Midland Avenue at the north-east corner with South Shields Avenue in the Agincourt neighbourhood and contains a one-and-a-half storey house dating to c. 1875. In 2006, City Council listed the property at 3315 Midland Avenue, containing a house historically known as the George L'Amoreaux farm house (c.1875), on the City of Toronto's Inventory of Heritage Properties (now known as the Heritage Register). The property has been identified as having archaeological potential in accordance with the City of Toronto's Archaeological Master Plan. Following research and evaluation, it has been determined that the property at 3315 Midland Avenue meets Ontario Regulation 9/06, the criteria prescribed for municipal designation under Part IV, Section 29 of the Ontario Heritage Act for its design, associative and contextual value. The owner of the property at 3315 Midland Avenue has submitted a Notice of Intention to demolish a listed heritage property under the Ontario Heritage Act. The application is incomplete. In accordance with Official Plan Heritage Policies, properties on the Heritage Register will be conserved and maintained. Designation enables City Council to review alterations to the site, enforce heritage property standards and maintenance, and refuse demolition.

The Acting Chief Planner and Executive Director, City Planning Division, recommends that: 1. City Council state its intention to designate the property at 3315 Midland Avenue under Part IV, Section 29 of the Ontario Heritage Act, in accordance with the Statement of Significance: 3315 Midland Avenue (Reasons for Designation) attached as Attachment 3 to the report (November 15, 2017) from the Acting Chief Planner and Executive Director, City Planning Division. 2. If there are no objections to the designation in accordance with the Ontario Heritage Act, City Council authorize the City Solicitor to introduce the necessary bill in Council. 3. If there are objections in accordance with the Ontario Heritage Act, City Council direct the City Clerk to refer the proposed designation to the Conservation Review Board. 4. If the designation is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend any hearing held by the Conservation Review Board in support of Council's decision to designate the property.

This report provides information and identifies a preliminary set of issues regarding applications for Official Plan and Zoning By-law Amendments to permit the redevelopment of the lands at 3355, 3357, 3365 Kingston Road, and 34 Annis Road. The applications propose to demolish the existing buildings on site and construct an 11-storey mixed-use building along Kingston Road and a row of townhouses fronting on Annis Road. Staff are currently reviewing the applications, which have been circulated to all appropriate agencies and City divisions for comment. Staff will proceed to schedule a community consultation meeting on the applications with the Ward Councillor.

This application proposes to amend the Official Plan to add a Site and Area-Specific Policy ("SASP") for the property at 1900 Eglinton Avenue East (see Attachment 1: Location Map) to permit a mixed-use development including new public streets and parkland. The subject lands are located within the Golden Mile Secondary Plan ("Secondary Plan") area approved through Official Plan Amendment No. 499 ("OPA 499"), and are also subject to new Golden Mile Urban Design Guidelines, as adopted by City Council on October 30, 2020. The application was submitted on August 20, 2019 and has been appealed to the Local Planning Appeal Tribunal ("LPAT") citing City Council's failure to make a decision within the prescribed time frames set out in the Planning Act. The appeal was filed on April 23, 2020, during the COVID-19 state of emergency. The purpose of this report is to seek City Council's direction for the City Solicitor, together with appropriate City staff and/or external consultants, to attend the LPAT hearing to oppose the subject application. City staff have concerns with the proposed Official Plan Amendment and are of the opinion that the proposed amendment, in its current form is not consistent with the Provincial Policy Statement (2020) ("PPS"), does not conform with the A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020) ("Growth Plan (2020)"), and is not consistent with the general intent of and fails to conform with the Official Plan. City Council direct the City Solicitor to request the owner of the subject lands address the preliminary issues related to infrastructure required to support the anticipated growth in the overall context of the Golden Mile Secondary Plan ("GMSP") area, including streets, density, servicing, parks, and community service facilities which are to be assessed comprehensively, including coordination with other GMSP landowners. 4.
